RATE ADJUSTMENI'S III Charges resulting from application of the above rates shall be adjusted in accordance with the provisions of the Fuel Clause and the Tax Clause, which are more fully described below: RlEL CLAUSE The Energy Charge shall be: (a) increased by one-tenth (1/10th) mill per KWH for each one cent, or major fraction thereof, by which the average delivered cost of fuel used during the preceding calendar month by the Authority at the Sim Gideon Steam Plant near Bastrop, Texas, exceeds twenty-one cents (21~) per million (1,000,000) BTU; (b) decreased.1by one-tenth (1/l0th) mill per KWH for each one cent, o or maj or fraction thereof, by which the average delivered cost of fuel used during the preceding calendar month by the Authority at the said Sim Gideon Steam Plant is less than nineteen cents (19\,) per million (1,000,000) BTU. TAX CLAUSE I The Billing Demand Charge and the Energy Charge are subj ect to appropriate ad jus tments to compensate for any tax, license, or other governmental imposition, or increase thereof, (except general ad valorem taxes or income taxes ) which affects the cost to Authority of power and energy to be delivered and which tax, license, or other governmental imposition is imposed upon the Authority or upon its electric business subsequent to the effective date of this ordinance. MIND1lJM ANNUAL BILL I Customers taking seTlTice lIDder this schedule shall pay a minilmJrn charge for demand and energy during each contract year equal to $32.80 per KW of 'tlili co~lr~':: contracted load, or $32.80 per KW of the highest actual KW demand established during said contract year, whichever is the greater. Said mininuun annual charge of $32.80 per kilowatt provided for hereinabove shall be collected in twelve (12) equal installments (herein referred to as monthly mininuun bills) except that if during the current contract year;. (a) previous monthly bills for demand~d energy have exceeded a pro :rata portion of the annual mininuun, minimum hi:\.l requirements for the current month shall be waived to the extent of such excess;, or (b) previous monthly bills for demand and energy do not equal the pro rata portion of the annual mininuun due to a higher demand having been established by customer during the current billing month than the billing demands established by customer during previous months of the current contract year, an additional amolIDt shall be included in the billing for the current month in order that the total amount billed during the current, contract year ( including the billing ~6r the current month) shall be equal to the pro rata portion of the annual mininuun based upon the highest billing demand established during the current contract year; or (c) monthly bills paid by customer have included amolIDts necessary to fulfill the monthly mininuun bill requirements, the portion of such amolUlts which have been carried forward to the current month as set out below may be used to reduce the Energy Charge for the current month. To the extent that the amolIDts necessary to fulfill montl1ly mininuun bill requirements are not used to reduce the Energy Charge in the current month such lUlUSed amolIDts may be carried forward for use in subsequent months of the current contract year.
