<br />I <br /> <br />I <br /> <br />I <br /> <br />_m -,_- '-I ""-II I <br /> <br />195d <br /> <br />above operational costs in real and personal property for <br /> <br /> <br />the betterment of such golf course, and that the title to <br /> <br /> <br />all such real property improvements and golf course equip- <br /> <br /> <br />ment would at all times be vested in the landlord, which, <br /> <br /> <br />at this time, is Aquarena, Incorporated. An inventory of <br /> <br /> <br />the existing Golf Course Equipment, prepared by the San <br /> <br /> <br />Marcos Golf Association and Jack C. Sanchez, the new pro- <br /> <br /> <br />fessional, and is attached hereto and made a part of this <br /> <br /> <br />lease contract. When the lease from Aquarena, Incorporated, <br /> <br /> <br />is terminated by expiration of the term of the lease or other- <br /> <br /> <br />wise, then all of said equipment and cash and all other asse1:s <br /> <br /> <br />of said Association shall be delivered to and remain the <br /> <br /> <br />property of Aquarena, Incorporated, and the sub-lease between <br /> <br /> <br />the City of San Marcos and the said San Marcos Golf Association <br /> <br /> <br />shall so provide, and the remaining of that personal propert:{ <br /> <br /> <br />on said premises shall be guaranteed by the City of San Marcos, <br /> <br /> <br />and shall be the obligation of the City as well as the said <br /> <br /> <br />Associaton toward Aquarena, Incorporated. The said sub-contract <br /> <br /> <br />of lease between the City and the said Association shall further <br /> <br /> <br />provide that if, as and when said Association moves to other <br /> <br /> <br />premises, it shall not have the right to take such moveable <br /> <br /> <br />property to its new location, but all of same shall remain on <br /> <br /> <br />the premises of Aquarena, Incorporated, golf course, and this <br /> <br /> <br />result shall be guaranteed by the City of San Marcos, as well <br /> <br /> <br />as by the said Association. Nothing herein contained is in- <br /> <br /> <br />tended to prohibit or prevent the said Association from trading <br /> <br /> <br />in the existing equipment for similar new equipment, or from <br /> <br /> <br />purchasing additional equipment during the term of this lease, <br /> <br /> <br />but the title to all such new equipment, when hereafter acquired, <br /> <br /> <br />shall immediately vest in Aquarena, Incorporated, and shall in <br /> <br /> <br />all things be governed by this contract, and the City of San <br />
