The City of San Marcos <br /> <br /> <br />shall furnish to Aquarena, Incorporated, a copy of its <br /> <br /> <br />proposed form of contract of sublease with the said Association, <br /> <br /> <br />and said sublease shall be approved by Aquarena, Incorporated, <br /> <br /> <br />prior to its execution, otherwise this lease contract to the <br /> <br /> <br />City of San Marcos shall be null and void, and of no force <br /> <br /> <br />and effect. <br /> <br /> <br />The lease for the years 1968 through 1976, inclusive, <br /> <br /> <br />were similar to this lease, in that the City of San Marcos paid <br /> <br /> <br />rent in the precise amount of all ad valorem taxes on said <br /> <br /> <br />property for each of said year, and was reimbursed for one- <br /> <br /> <br />half (1/2) thereof by the San Marcos Golf Association. <br /> <br /> <br />VII. <br /> <br /> <br />The purpose of this lease is to permit Lessee to continue <br />to operate said property as a municipal golf course; and Lessee <br />binds and obligates itself that it will use said property solely <br />and exclusively for the purpose of conducting thereon a muni.cipal <br />golf course, and will not use said property, or any part thereof, <br />for any other purpose; and will not assign this lease in whole <br />or in part; and will not sublet any part of the property covered <br />hereby, to any person, firm, partnership, corporation, or any <br />other organization other than San Marcos Golf Association. <br />VIII. <br />A part of the consideration and rent for this lease agree- <br />ment is the obligation of the City of San Marcos to sublease <br />the said golf course to the San Marcos Golf Association by an <br />instrument in writing which shall not in any way be in conflict <br />with, but shall be wholly in accord with, the terms and pro- <br />visions of this lease to the City of San Marcos; and Aquarena, <br />
