I I I 1m -5- 2/24/77 195e Marcos shall so contract with the said Association in the proposed instrument of sublease. The City of San Marcos shall furnish to Aquarena, Incorporated, a copy of its proposed form of contract of sublease with the said Association, and said sublease shall be approved by Aquarena, Incorporated, prior to its execution, otherwise this lease contract to the City of San Marcos shall be null and void, and of no force and effect. The lease for the years 1968 through 1976, inclusive, were similar to this lease, in that the City of San Marcos paid rent in the precise amount of all ad valorem taxes on said property for each of said year, and was reimbursed for one- half (1/2) thereof by the San Marcos Golf Association. VII. The purpose of this lease is to permit Lessee to continue to operate said property as a municipal golf course; and Lessee binds and obligates itself that it will use said property solely and exclusively for the purpose of conducting thereon a muni.cipal golf course, and will not use said property, or any part thereof, for any other purpose; and will not assign this lease in whole or in part; and will not sublet any part of the property covered hereby, to any person, firm, partnership, corporation, or any other organization other than San Marcos Golf Association. VIII. A part of the consideration and rent for this lease agree- ment is the obligation of the City of San Marcos to sublease the said golf course to the San Marcos Golf Association by an instrument in writing which shall not in any way be in conflict with, but shall be wholly in accord with, the terms and pro- visions of this lease to the City of San Marcos; and Aquarena,
