<br />I <br /> <br />I <br /> <br />lorn -8- 2/24/77 <br /> <br />195h <br /> <br />I <br /> <br />XIII. <br />In the event that any improvements upon said property <br />are damaged or destroyed during the term of this lease by <br />fire or Act of God, neither party shall be under any obligation <br />to replace or restore such damaged or destroyed improvements. <br />XIV. <br />The Sub-Lessee, the San Marcos Golf Association, shall <br />be at full liberty during the term of this lease to make an <br />arrangement with a professional golfer to operate a concession <br />on said premises, and the profits, if any, realized by the <br />professional golfer from the operation of such concession on <br />said premises, shall be and remain the sole property of said <br />golfer, and Lessor shall have no claim, or assert any right 1:0 <br />any part or percentage thereof. <br />xv. <br /> <br /> <br />Lessor reserves from the land leased for golf course <br /> <br /> <br />purposes, the small area or portion thereof formerly used as <br /> <br /> <br />a heliport, marked off by posts with a cable running from post <br /> <br /> <br />to post, and forming an area enclosed by such posts and cabl,=, <br /> <br /> <br />except that both ends of said area open on to a paved road, 'which <br /> <br /> <br />paved road affords ingress to and egress from Aquarena amuse- <br /> <br /> <br />ment area proper, and the reservation of such area is for the <br /> <br /> <br />parking of automobiles when necessary, by the customers of <br /> <br /> <br />Aquarena amusement enterprises. <br /> <br /> <br />Also, if additional parking space is needed at peak periods, <br /> <br /> <br />Aquarena, Incorporated, is authorized to recapt~re possession <br /> <br /> <br />for such period of time for public parking purposes, the tee <br /> <br /> <br />end of number seven (7) fairway for approximately seventy-five <br /> <br /> <br />(75) yards, thereby moving the tee temporarily toward the hole <br /> <br /> <br />about seventy-five (75) yards, provided that no parking shall be <br /> <br /> <br />permitted on the elevated portion of the regular number seven <br />
