<br />I <br /> <br />20la <br /> <br />THE STATE OF TEXAS <br />COUNTY OF HAYS <br /> <br />FRANCHISE <br /> <br />I <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br /> <br />That on this 28 day of February, A.D., 1977, t~e City of <br /> <br /> <br />San Marcos, Texas a municipal corporation duly incorporated and <br /> <br /> <br />existing as a home rule city by and under the laws of the State <br /> <br /> <br />of Texas, acting through its Mayor, Dr. Emmie Craddock, or her <br /> <br /> <br />successor, hereunto duly authorized QY <br /> <br /> <br />ordinance of the City Council of the City of San Marcos, and the <br /> <br /> <br />Lower Colorado River Authority, hereinafter referred to as "Grantee", <br /> <br /> <br />an agency of the State of Texas, its successors and assigns, pro- <br /> <br /> <br />viding electrical energy to the City of San Marcos, entered into <br /> <br /> <br />this franchise agreement to be effective from January 1, 1977 until <br /> <br /> <br />January 1, 1978; the terms of said agreement being as follows: <br /> <br /> <br />Section 1. That the word "Grantee" as employed in this <br /> <br /> <br />Ordinance shall denote the Lower Colorado River Authority, an <br /> <br /> <br />agency of the Sta~e of Texas, its successors and assigns. <br /> <br /> <br />Section 2. That said Grantee shall be and is hereby granted <br /> <br /> <br />the right for a period of one (1) year from and after January 1, 1977, <br /> <br /> <br />with full right, power and authority to erect, extend, operate and <br /> <br /> <br />maintain towers, poles, wires, mains, pipes, and all other apparatus <br /> <br /> <br />and appliances, within the corporate limits of the City of San <br /> <br /> <br />Marcos, Texas, as now existing or as may be hereafter extended, for <br /> <br /> <br />the purpose of distributing electric power and energy for lights, <br /> <br /> <br />heat and power, including distribution of electric power and energy <br /> <br /> <br />to the City and its inhabitants, and for said purposes the privilege <br /> <br /> <br />to enter upon and use the streets, alleys and public grounds of <br /> <br /> <br />said City, and construct, maintain and operate on, over, and across its, <br /> <br /> <br />streets, alleys and public grounds, such poles, wires, mains, pipes, <br /> <br /> <br />apparatus and appliances as may be necessary and proper, all sliliject <br /> <br /> <br />to the terms and conditions hereafter provided. City recognizes the <br /> <br /> <br />right of Lower Colorado River Authority to erect, maintain, and <br /> <br /> <br />operate electric transmission lines on, over and across the streets <br /> <br /> <br />and alleys of the City. <br /> <br />I <br />
