<br />20lb <br /> <br />Section 3. That said poles, wires, ~ains, pipes and other <br /> <br />apparatus and appliances shall be erected, placed or laid in such <br /> <br />places and manner as will be consistent with what is necessary or <br /> <br />convenient, and with public safety, and so as to least interfere with <br /> <br />other public uses of said public streets, alleys and public grounds, <br /> <br />and said streets shall not be unnecessarily obstructed and shall <br /> <br />within a reasonable length of time be placed as nearly as practi- <br /> <br />cable in as good condition and'repair as before so obstructed at <br /> <br />the expense of said Grantee; and the said Grantee shall hold the <br /> <br />City harmless from any liabilities arising from any act, negligence, <br /> <br />or ~nIDssion of said Grantee. <br /> <br />Section 4. Grantee, through its distribution lines, furnishes <br /> <br />and will continue to furnish electric power and energy to City <br /> <br />for Ilse by the City in providing the inhabitants of City the <br /> <br />following essential services: water supply, sewerage disposal, <br /> <br />light:ing of thoroughfares, public parks, and traffic signals; at <br /> <br />the rates and under the conditions specified in Grantee's rate <br /> <br />schedules then applicable thereto, as duly passed and adopted by <br /> <br />separate ordinance of the City Council of the City of San Marcos: <br /> <br />Section 5. For each calendar year, beginning January 1, 1977, <br /> <br />and continuing as long as this franchise is in full force and <br /> <br />effect, Grantee shall pay to the City of San Marcos, on a quarterly <br /> <br />basis, on the first day of January, April, July, and October of <br /> <br />each year a rental as duly passed and adopted by separate ordinance <br /> <br />of th,;;! City Council of the City of San Marcos. <br /> <br />SectionG6. Said rental, as established by separate ordinance, <br /> <br />shall be for the privilege of entering upon and using the streets, <br /> <br />alleys and public grounds of said City for the purpose of constructing, <br /> <br />maintaining and operating on, over, and across said streets, alleys <br /> <br />and ptililic grounds of said City for the purpose of constructing, <br /> <br />maintaining and operating on, over, and across said streets, alleys <br /> <br />and public grounds, such poles, wires, mains, pipes, apparatus <br /> <br />as may be necessary to "Grantee" for its distribution of electric <br /> <br />energy within the corporate limits of the city of San Marcos, Texas, <br /> <br />, <br />as now existing or hereafter extended. <br /> <br />Section 7.
