<br />Ci ty of San Marcos, Texas,. be held as assuming any liability I
<br />by reason of .the inspec:tions authorized he. rein, or any certi-
<br />ficate or peI11li t issued pursuant. to the prov,isions, .of :tpis
<br />Ordinance. . .

<br />SECTION 9. PREVIOUS AIR CONDITIONING CODE REPEALED.
<br />
<br />That that'O'rd,irtance of :the City of..S~n'Marcos, Texas, duly
<br />passed and adopted qnSeptember 9, '1974', as 'se.t out in Volume
<br />44, page 46 of' the Minutes of the City Council of San Marcos,
<br />providing for an air condi tioning code., as amended, be, and is
<br />hereby, r~pealed. 1.'."

<br />SECTION 10. 'PREVIOUS AIR' CONDIT-IONING FEES REPEALED.
<br />
<br />Th~t that ordinqnce of the City of San Marcos, Texas, du~y
<br />passed and adopted on August 11, 1975,. as set out in Volume 45,
<br />page 87 of the Minutes. of the City Council of San Marcos, providing
<br />for air conditioning,work fees,. as amended,. be, and is hereby
<br />~epealed. '. ....c., . ' .

<br />SECTION 11. CONFLICTS.
<br />
<br />That all these .other ordinances or parts' of ordinances
<br />of the City of San Marcos, Texas, in conflict with.this Ordi-
<br />nance be and the same are hereby in all respects repealed.

<br />SECTION 12. SAVINGS CLAUSE.
<br />

<br />
<br />That if any section, paragraph, sentence, or phrase of this
<br />Ordinance be invalid, or unconstitutional, then such invalid or
<br />unconstitutional portion shall not in any way affect the remainder
<br />of this Ordinance, and it is hereby declared as the in~ent of the
<br />City Council of the City of San Marcos, Texas, that the remainder
<br />of this Ordinance would have been passed by the City Council of
<br />the City of San Marcos, Texas, notwithstanding the invalidity or
<br />unconstitutionality of such section, paragraph, sentence, or
<br />phrase.

<br />SECTION 13. PENALTY.
<br />
<br />That .any person" firm or corporation who violates any part
<br />of this Ordinance shall be guilty of a misdemeanor, and upon con-
<br />viction thereof, shall be fined an amount not to exceet Two
<br />Hundred Dollars ($200.00). Each and every day any violation
<br />of any provision of this Ordinance shall continue, it shall be
<br />deemed a separate 'offence. Prosecution or conviction under this
<br />provision shall never be a bar to any other remedy or relief,
<br />in law or in equity, for'violations of this Ordinance.
