<br />52a <br /> <br />THE STATE OF TEXAS <br /> <br />LEASE <br /> <br />COUNTY OF HAYS <br /> <br />KNOI'J ALL HEN BY THESE PRESENTS: <br /> <br />I <br /> <br />That on this 13th day of June, A.D. 1977, the City of San <br />Marcos, Hays County, Texas, a municipal corporation existing by <br />and under the laws of the State of Texas, hereinafter referred <br />to as "ci ty", acting through i ts ~layor, Mr. Frank T. Arredondo, <br />hereunder duly authorized by resolution of the City Council of <br />the City of San Marcos, and the King David Masonic Lodge No. 33 <br />AF-AM, hereinafter referred to as "Lodge" entered into this lease <br />of property for the mutual benefit of the parties and pursuant <br />to the following considerations, terms, provisions: <br /> <br />I. <br /> <br />"City"agrees to lease to the "Lodge" that property and struc-' <br />ture known as the "Comal Recreation Center", more specifically <br />described as part of lot 14, Block 16, Original Town of San Marcos <br />(southernmost 55') . <br /> <br />II . <br /> <br />The term of this lease is for a period of twenty (20)years <br />commencing on the date of execution hereof. <br /> <br />III. <br /> <br />I <br /> <br />"Lodge" agrees to use the property described above to pro- <br />mote communi ty recreational acti vi ties and as a meeting place, <br />without restriction, for clubs, churches, lodges ~nd other <br />organizations of the community. <br /> <br />IV. <br /> <br />"Lodge" agrees to maintain the demised premises in good repair <br />for use by the public and that "City" shall incur no expense in <br />maintenancing the premises during the term of the lease nor expense <br />for the co~t of utilities in operating the premises. <br /> <br />V. <br /> <br />"Lodge" agrees to indemnify and forever save harmless the <br />City of San Marcos and to keep the "City" free from all liability <br />arising out of any claim, action or suit for damages to persons <br />or property resulting from any occupation or' use of the demised <br />premises. <br /> <br />VI. <br /> <br />I <br /> <br />"Lodge" agrees to keep on fi Ie wi th the "Ci ty" a policy of <br />public liability insurance issued by a casualty insurance company <br />duly authorized to do business in the State of Texas to the minimum <br />limit of $100,000.00 per person and $300,000.00 for any single <br />occurrence for bodily injury or death and to $10,000.00 for any <br />singlc OCCllrrence for injury to or dcstruction of property, re- <br />sulting frol1l 'my occupation or use of tlw demised. premises. <br />
