Regular Meeting <br /> <br />May 10, 2004 <br /> <br /> 148. <br />Page 3 <br /> <br />Ms. Narvaiz moved for approval of the Ordinance on first reading and Mr. <br />Taylor seconded the motion. Mr. Taylor inquired how long these funds have <br />been collected, and Mr. O'Leary responded since 1999. The Council then <br />voted unanimously for the approval of the Ordinance on first reading. <br /> <br />Mayor Habingreither introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER 14, BUILDINGS AND BUILDING REGULATIONS, OF THE SAN <br />MARCOS CITY CODE, TO CREATE A LIMITED EXEMPTION FROM THE INSURANCE <br />REQUIREMENTS FOR BUILDING CONTRACTORS FOR PERSONS CONSTRUCTING <br />SINGLE-FAMILY HOMES ON PROPERTY OWNED BY THEM AND TO BE OCCUPIED AS <br />THEIR HOMESTEADS; INCLUDING PROCEDURAL PROVISIONS. <br /> <br />Mr. Taylor moved for approval of the Ordinance on first reading, and Ms. <br />Narvaiz seconded the motion. Mayor Habingreither stated a citizen has <br />signed up to speak on this item. Joe Schneider stated he feels the <br />Council should consider two items 1) a sixty-day grace period for anyone <br />that has held a license with the City of San Marcos and qualifies to renew <br />the license without a test, and 2) revise Section 14.375(d) (1) to read <br />that a person has to keep the home as personal property for one year. Mr. <br />Thomaides stated he would prefer approving the Ordinance as it is now and <br />amending after Council has a chance to review Mr. Schneider's letter. Mr. <br />O'Leary stated this Ordinance was amended 2-1/2 years ago to amend the <br />testing of contractors. He stated Council clarification was needed on the <br />amended Ordinance. Mayor Habingreither stated he would agree to table the <br />Ordinance until the Council has time to study Mr. Schneider's request. <br />Ms. Narvaiz stated she supports delaying the Ordinance so Mr. Schneider's <br />revisions can be considered. Mr. Taylor stated he supports contractors <br />being able to build their own homes. He stated he knows that some <br />contractors have paid for one month of insurance in order to get the <br />required documentation, and then discontinue their payments. Mr. Montoya <br />moved to amend Section 14 375(d) (1) to strike <br />ho ......... and replace with owned by the person for at least one year, and <br />Mr. Diaz seconded the motion. On roll call the following vote was <br />recorded: <br /> <br />AYE: <br /> <br />Montoya and Diaz. <br /> <br />NAY: <br /> <br />Narvaiz, Thomaides, Habingreither and Taylor. <br /> <br />ABSTAIN: None. <br /> <br />The motion failed. The Council then voted unanimously for approval of the <br />Ordinance on first reading. <br /> <br /> <br />
