Mayor Habingreither stated he spent two days in Monclova and <br />feels the City can benefit from this relationship. The Council then voted <br />unanimously for adoption of the Resolution. <br /> <br />Mayor Habingreither introduced for consideration Item 19, removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br />follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AN AMENDMENT TO THE COMMUNITY DEVELOPMENT BLOCK GRANT <br />('~CDBG") FUNDED FIRST-TIME HOMEBUYER'S PROGRAM TO REMOVE THE TARGET <br />AREA DESIGNATION; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Thomaides moved for adoption of the Resolution and Mr. Montoya <br />seconded the motion. Mr. O'Leary stated this program begain on May 3, <br />2004 and within two days the City had handed out sixty applications. Ms. <br />Narvaiz stated she feels this program will create positive development in <br />neighborhOods. Linda Costley, Community Development Coordinator, stated <br />she has received fifteen applications back and five of those have been <br />sent to participating lenders. Mr. Montoya stated with interest rates <br />going up he feels it is unfair to limit this program to certain areas of <br />the City. Mayor Habingreither stated he feels this is a positive program. <br />The Council then voted unanimously for adoption of the Ordinance on third <br />and final reading. <br /> <br />Mayor Habingreither introduced for consideration Item 23, removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br />follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />DECLARING A DEFAULT BY HAYS ENERGY, L.P., UNDER THE AMENDED AND <br />RESTATED TAX ABATEMENT AGREEMENT BETWEEN THE CITY AND HAYS ENERGY <br />L.P.; DIRECTING THE CITY MANAGER TO SEND NOTICE OF THE DEFAULT; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Taylor moved for adoption of the Resolution and Ms. Narvaiz seconded <br />the motion. Mayor Habingreither stated a citizen has signed up to speak <br />on this item. Jay Temple, Hays Energy, asked Council to table this item <br />for 30 days. He stated the 30 days should give Hays Energy enough time to <br />work out a deal with the City. He stated on February 3, 2004, a meeting <br />was held with Mr. O'Leary and Rodney Gonzales to discuss the Tax Abatement <br />Agreement. He stated one month later an audit was done to ascertain the <br />number of employees. He stated Mr. Gonzales called to notify of default. <br />He stated Hays Energy responded with an explanation and requested 30 days <br />to provide a solution to their problem. Mr. Taylor stated Hays Energy is <br />a $350 million dollar project with $1,567,500.00 in property taxes. He <br />stated he supports giving Hays Energy the 30-day extension. Mr. <br />Thomaides stated with the extension of 30-days, it will really total a 90- <br /> <br /> <br />
