<br />I <br /> <br />RESOLUTION NO. 1977-52-R <br /> <br />172 I <br /> <br />A RESOLUTION OF THE CITY OF SAN MARCOS, TEXAS, <br />SUSPENDING THE OPERATION OF PROPOSED RATE SCHE- <br />DULES FILED BY LOWER COLORADO RIVER AUTHORITY <br />FOR A PERIOD OF ONE HUNDRED TWENTY (120) DAYS <br />BEYOND THE DATE ON WHICH SUCH SCHEDULES WOULD <br />OTHERWISE GO INTO EFFECT, AND DIRECTING LOWER <br />COLORADO RIVER AUTHORITY TO PROVIDE OPERATING <br />DATA FOR A TEST YEAR ENDING SEPTEMBER 30, 1977. <br /> <br />WHEREAS, Lower Colorado River Authority did, on October 11, 1977, file <br />a schedule of rates for electric service within the City of San Marcos, <br />to become effective November 16, 1977; and, <br /> <br />WHEREAS, after having heard the presentation of Lower Colorado River <br />Authority, it is the opinion of the City Council of the City of San <br />Marcos that such schedule of rates should be suspended for a period <br />of 120 days from November 16, 1977, for further study, investigation, <br />presentation of evidence and public hearing; and, <br /> <br />WHEREAS, any determination of the appropriate rates for Lower Colorado I <br />River Authority within the City of San Marcos should be based on the <br />most recent test year for which operating data are available; and, <br /> <br />WHEREAS, a copy of this resolution has been provided Lower Colorado <br />River Authority prior to its consideration by the City Council of <br />the City of San Marcos; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />I <br /> <br />Part 1. Pursuant to Section 43(d) of the Public Utility Regulatory <br />Act, the operation of the Lower Colorado River Authority's proposed <br />rate schedules filed with the City of San Marcos on October 11, 1977, <br />is hereby suspended for a period of 120 days from November 16, 1977, <br />for further study, investigation, presentation of evidence an~ public <br />hearing. <br /> <br />Part 2.
