8. Public Update on ZC- 09 -17, Ordinance 2010 -25, adopted May 4, 2010, amending the <br />• official zoning map of the City by rezoning a 12.88 acre, more or less, tract of land out of <br />the Thomas J. Chambers Survey Abstract No. 2 located at 1314 Franklin Drive from "SF- <br />6" Single Family Residential District to "MU" Mixed Use District; and including <br />procedural provisions. <br />City Manager Rick Menchaca reported that at the May 4 City Council meeting two petitions <br />protesting the change were presented. During review of the petitions, staff discovered there had <br />been six addressing errors. This has been referred back to Planning and Zoning at their May 25 <br />regular meeting, and new notifications have been mailed out. The petitions are still valid <br />because this is still in process. Staff has verified that the other Buie tracts were accurate. Staff is <br />also looking at long term remedies. <br />9. Discussion on deer within the City limits, and provide direction to staff. <br />Rodney Cobb, Director of Community Services, updated the City Council on the issues <br />concerning deer population in San Marcos. Survey results identified that actions needed to be <br />taken to reduce the deer population. However, there was no clear consensus on what action <br />needs to be taken. The survey also indicated that a Citizen Task Force should be created to <br />develop a management strategy. <br />The Animal Services Advisory Board was directed to look at education, prohibition against <br />feeding the deer and enforcement, and to return with a preliminary deer management <br />recommendation for the Council's consideration. <br />CONSENT AGENDA <br />10. Consider adoption on second and final reading of Ordinance 2010 -26, amending the <br />City's 2009 -2010 budget to authorize the expenditure of funds out of the Landfill Reserve <br />Fund in the sum of $80,620 and $89,350 from the General Fund Cash Supported CIP for <br />various City proiects; and providing an effective date. <br />12. Consider adoption on second and final reading of Ordinance 2010 -27, amending <br />Chapter 18, Businesses, Article 6, Sexually Oriented Businesses, of the San Marcos City <br />Code to change definitions and location requirements; providing for penalties; and, <br />including procedural provisions. <br />13. Consider adoption of Resolution 2010 -68R, approving a 20 foot wide electric utility <br />easement to Bluebonnet Electric Cooperative, Inc. across a portion of a 2.51 acre, more or <br />less tract of land in the Cottonwood Creek Subdivision to enable the provision of electric <br />service to the Cottonwood Creek elevated water storage tank; authorizing the City <br />Manager to execute said agreement; and declaring an effective date. <br />RM051810 Minutes Page 7 <br />
