. There being no further comments, the Public Hearing was closed at 9:55 p.m. <br />NON - CONSENT AGENDA <br />25. Consider appointments to the following Boards and C <br />A. Ethics Review Commission. <br />John McGlothlin was appointed to the Ethics Review Commission. <br />26. Consider an ordinance amending the City's 2009 -2010 budget to authorize the <br />expenditure of funds out of the Landfill Reserve Fund in the sum of $80,620 and $89,350 <br />from the General Fund Cash Supported CIP for various City proiects; a nd providing an <br />effective date; and consider ordinance on the first of two read ings. <br />MOTION: Upon a motion made by Councilmember Porterfield and a second by <br />Councilmember Thomaides, the City Council voted seven (7) for and none (0) opposed, to <br />approve the ordinance on the first of two readings. The motion carried unanimously. <br />27. Consider an ordinance amending Chapter 18, Businesses, Article 6, Sexu Oriented <br />Businesses, of the San Marcos City Code to change definitions and location r <br />providing for penalti and, including procedural provisions; and consider ordinance on <br />• the first of two readings. <br />MOTION: Upon a motion made by Councilmember Porterfield and a second by <br />Councilmember Thomaides, the City Council voted six (6) for and none (0) opposed, with <br />Councilmember Bose abstaining, to approve the ordinance on the first of two readings, amending <br />the draft to add back in the three foot rule and to prohibit any contact between the performer and <br />the customer. The motion carried. <br />28. Discussion on the necessity of an ordinance that requires permitting of itinerate <br />carnivals, and provide direction to staff. <br />Police Chief Howard Williams reported we do not have any regulations that address itinerate <br />carnivals. The City Council directed staff to proceed. <br />29. Discussion on deer within the City limits, and provide direction to staf <br />MOTION: Upon a motion made by Councilmember Terry and a second by Councilmember <br />Thomason, the City Council voted seven (7) for and none (0) opposed, to table this item until the <br />May 18 meeting. The motion carried unanimously. <br />Council directed staff to place this item at the beginning of the agenda. <br />30.
