The city council finds and determines, based <br />on these studies, that the regulation of se� a+ally adult oriented businesses is <br />necessary to control and limit these adverse secondary effects. <br />(b) The purpose of this chapter is to regulate adult businesses in order to control their <br />adverse secondary effects in the community. The purpose of this chapter is neither to <br />deny access to or communications of materials protected by the First Amendment to the <br />United States Constitution, nor to condone or legitimize such materials. <br />Sec. 18.243. Enforcement. <br />(a) A person who violates any provision of this article regarding a adult 6e*Ha4 <br />oriented business mee g l3a pri,mry li.17si css tzss in ' S.244- is subject to prosecution <br />under V.T.C.A., Local Gov't Code, Chapter 243. <br />(b) It is a defense to prosecution under subsection 18.25 or section 18.2534- that a <br />person appearing in a state of nudity did so in a modeling class operated: <br />(l ) By proprietary school licensed by the state; a college, junior college or <br />university supported entirely or partly by taxation; <br />• <br />13 <br />
