175-a <br />LEASE <br />STATE OF TEXAS <br />COUNTY OF HAYS <br />KNOW ALL MEN BY THESE PRESENTS: <br />That the City of San Marcos, Texas, a municipal corporation <br />under the laws of the State of Texas, acting by and through the <br />authority conferred on its Mayor, Dr. Emmie Craddock, and herein- <br />after referred to as "City", by Resolution adopted January 12, <br />1976, and The Texas Museum of History, Inc., a non-profit corpor- <br />ation pursuant to the Texas Non-Profit Corporation Act, hereinafter <br />referred to as "Museum", enter into this lease of property for the <br />mutual benefit of the parties and pursuant to the following terms <br />and provisions: <br />I. <br />The subject property of this lease is that structure owned by <br />City in the 200 Block of North Guadalupe Street in said City and <br />previously utilized as the City Hall and commonly known in the <br />community as the "old City Hall." <br />II. <br />The term of this lease is for the calendar year 1976. Upon <br />the expiration of this lease agreement a renewal of said lease may <br />be negotiated, but it is expressly agreed that no right of renewal <br />or extension of this lease is hereby conveyed. <br />III. <br />Consideration for this lease agreement is City providing a <br />site for Museum to display historical artifacts during the Bicen- <br />tennial Year and Museum making said artifacts available for the <br />public enjoyment and education of the citizens of San Marcos, <br />Texas. <br />IV. <br />It is expressly agreed that City shall incur no cost for <br />the adaptation of the premises for museum purposes nor for the <br />cost of maintenancing the premises during the term of this <br />lease nor for the cost of utilities in operating the museum or <br />making the museum available to the public. Museum does hereby <br />not to structurally alter the premises without first obtaining <br />the approval of the City Council. <br />agree <br />V. <br />It is expressly agreed that all historical artifacts dis- <br />played on the premises shall remain the property of Museum and City <br />shall exert no claim against such artifacts nor be responsible for <br />damage to or loss of artifacts kept on the premises. City agrees <br />to maintain the present level of insurance coverage on the struc- <br />ture, but expressly states that no insurance coverage shall be <br />held for the contents of the structure. <br />VI. <br />Museum agrees to provide evidence of liability insurance <br />coverage protecting Museum and naming City as an additional insured <br />against third persons insuring the acts and conduct of Museum <br />while on the leased premises. Minimum coverage shall be $100,000 <br />personal injury; $300,000 personal injury per occurrence; $100,000 <br />property damage. Failure to maintain said minimum coverage shall <br />be grounds for termination of this lease. <br /> <br />
