lm -7- 1/9/76 <br />known as the Old Post Road, across said golf course, and to the premises <br />occupied by the Aquarena amusement enterprise complex and to Aquarena <br />Springs Motor Hotel, and nothing herein contained shall give Lessee any <br />rights in and to the land occupied by said paved roads which would in any <br />wise conflict with Lessor's continued use of said roads as a means of <br />ingress to and egress from the public road to and from Lessor's amuse- <br />ment enterprises and hotel; but the use of said paved road areas by Lessee <br />shall be in such a way as not to interfere with the continued use by Lessor <br />of said paved strip of land for ingress and egress, and Lessee's right to <br />use said roads for golf club purposes shall be subordinate to Lessor's <br />right to use said roads for ingress and egress. <br />XI. <br />Lessor guarantees to Lessee the quiet and peaceable possession and <br />enjoyment of the property and premises hereby leased for the term hereof, <br />so long as the terms and provisions of this contract are complied with by <br />Lessee. And at the expiration of the term of this lease, Lessee agrees and <br />binds itself to re-deliver the property and premises to Lessor in as good <br />condition as same were at the beginning of the term of this lease, normal <br />depreciation and damage by fire or Act of God excepted. <br />XII. <br />In the event that any improvements upon said property are damaged <br />or destroyed during the term of this lease by fire or Act of God, neither <br />party shall be under any obligation to replace or restore such damaged <br />or destroyed improvements. <br />XIII. <br />Lessee, The San Marcos Golf Association, shall be at full liberty
