<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, CLOSING AND ABANDONING CERTAIN PORTIONS
<br />OF WOOD AND COMET STREETS AND A PORTION OF THE NORTH-
<br />SOUTH ALLEY BETWEEN McGEHEE AND NORTHCRAFT STREETS IN
<br />THE KATY ADDITION TO THE CITY OF SAN MARCOS, AND RELIN-
<br />QUISHING TO THE ADJACENT OWNERS, THE URBAN RENEWAL AGENCY
<br />OF THE CITY OF SAN MARCOS, MARIAN NELSON MEEKS, AND
<br />CHARLES VILLASENOR, ALL RIGHT, TITLE, AND INTEREST OF
<br />THE CITY OF SAN MARCOS, TEXAS, IN AND TO PORTIONS OF WOOD
<br />AND COMET STREET AND THE PORTION OF THE NORTH-SOUTH ALLEY
<br />PARALLEL TO McGEHEE AND NORTHCRAFT STREETS AND DIREQTING
<br />THE MAYOR TO EXECUTE AND DELIVER TO SAID P!':!{bUNb 'lU.LT-
<br />CLAIM DEEDS TO PORTIONS OF WOOD. AND COMET STREETS AND
<br />SAID PORTION OF THE NORTH-SOUTH ALLEY.
<br />
<br />WHEREAS, maps or plats of the portions of streets and alley to be closed and
<br />abandoned to which Deed of Dedication and map or plat reference is made and
<br />same made part hereof for all pertinent purposes; and,
<br />
<br />WHEREAS, the City of San Marcos, hereinafter referred to as the "City", made
<br />and entered into a Fourth Amended Cooperation Agreement with the Urban Renewal
<br />Agency of the City of San Marcos on May 6, 1974; and,
<br />
<br />WHEREAS, pursuant to S2(e) of said agreement, the City agrees to vacate and
<br />close such streets, alleys, and other public right-of-way as are required to be
<br />closed by the Urban Renewal Plan; and,
<br />
<br />WHEREAS, the Urban Renewal Plan requires the closing and ahandoning of certain
<br />portions of Wood. and Comet Streets and the portion of the North-South alley
<br />parallel to McGehee and Northcraft Streets in order to give full effect to the
<br />redevelopment plans for the Tex. A-G, N.D.P. area; and,

<br />
<br />WHEREAS, the Urban Renewal Agency owns all of the land on both sides of the
<br />portion of the North-South alley parallel to McGehee and Northcraft Streets; and,
<br />
<br />WHEREAS, the Urban Renewal Agency owns all of the land on the east side of the
<br />portion of Wood Street; and,
<br />
<br />WHEREAS, Charles Villasenor owns all of the land on the west side of the portion
<br />of Wood Street; and,
<br />
<br />WHEREAS, the Urban Renewal Agency owns all of lots 13, 14, 15, 16 and 17 of the
<br />Porter and Barbee subdivision of the City of San Marcos on the west side of the
<br />portion of Comet Street; and,
<br />
<br />WHEREAS, Marian Nelson Meeks owns the portions of lots 23, 25 through 32 of the
<br />Porter and Barbee subdivision of the City of San Marcos that adjoin the east side
<br />of the portion of Comet Street and owns all of lots 18, 19, 20, and 21 of the
<br />Porter and Barbee Subdivision of the City of San Marcos; and,
<br />
<br />WHEREAS, the Urban Renewal Agency of the City of San Marcos, Marian Nelson Meeks,
<br />and Charles Villasenor, petition the City of San Marcos to vacate and abandon
<br />said streets and alley; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:

<br />
<br />PART 1. That the North-South alley located between C .M. Allen Parkway and
<br />Cheatham Street and parallel to McGehee and Northcraft Streets be, and is
<br />hereby abandoned, vacated, closed and discontinued as a public alley in the City
<br />of San Marcos, Texas.
<br />
<br />PART 2. That the portion of Wood Street between Cheatham Street and Farm Lot 2
<br />of the Old Town of San Marcos be, and it is hereby abandoned, vacated, closed,
<br />and discontinued as a public street in the City of San Marcos, Texas.
