<br />the power and the proper responsibility of the government to prevent.
<br />
<br />(F) Protect and ensure the health, safety, and welfare of the
<br />inhabitants of the City of San Marcos.
<br />
<br />SECTION 32-4. Definition of. Terms.
<br />
<br />For the purposes of this Ordinance, the following terms or words and
<br />their derivations shall have the meaning ascr,ibed to them in this section.
<br />
<br />(A ) City. The City 0 f San Marcos, Hays County, Texas.

<br />(B) Commission. The Fair Housing Commission of the City of San Marcos,
<br />Hays County, Texas.
<br />
<br />(C) Dwelling. Any building, structure, or portion thereof which is
<br />occupied as, or designated and intended for occupancy as a residence by one or
<br />more families, and any vacant land which is offered for sale or lease for the
<br />construction and location thereon of any such building, structure, or portion
<br />thereof.
<br />
<br />(D) Discriminatory Practice. An act that is unlawful under Sections 32-5,
<br />32-6, and 32-1'.
<br />
<br />(E) Injure. To violate the legal right of another or inflict an action-
<br />able wrong.
<br />
<br />(F) Intimidate~ Willfull coercion with the intent to influence the action
<br />or inaction of another.
<br />
<br />(G) Person. Any individual, corporation, partnership, association, labor
<br />organization, legal representative, and any other organization or entity of what-
<br />ever .~haracter.
<br />
<br />(H) Rent. Includes to lease, to sublease, or otherwise to grant for con- I
<br />sideration the right to occupy premises not owned by the occupant. .
<br />
<br />ARTICLE II: SPECIAL PROVISIONS
<br />
<br />Section 32-5. Discriminatory Housing Practices.
<br />
<br />The following enumerated actions, policies, or practices, but not limited to
<br />those specifically listed, shall be considered discriminatory housing actions,
<br />policies, or practices and are prohibited and declared unlawful:
<br />
<br />(A) Refusing to sell or rent, after a bona fide offer is made, or refusing
<br />to nee;otiate for the sale or rental of, or to in any manner prohibitor. deny, a
<br />dwelling to any person because of said person's sex, race, color, religion, or
<br />national origin.
<br />
<br />(B} Prejudicial treatment of any person in the terms, conditions, restric-
<br />tions, provisions, or privileges of a sale or rental contract of a dwelling, or
<br />in the provision of associated services and facilities, because of said person's
<br />sex, race, color, rel~gion, or national origin.

<br />Making, printing, publishing, or causing to be made, printed, or
<br />any notice, statement, or advertisement, with respect to the sale or
<br />a dwelling that indicates a preference, limitation, or prejudicial
<br />or an intention to make such preference, limitation, or prejudicial
<br />aecauae of a person's sex, race, color, religion, or national origin.

<br />(D) Representing to any person that any dwelling is not available for
<br />inspection, sale, or rental, when such a dwelling is in fact so available,
<br />because of said person's sex, race, color, religion, or national origin.

<br />(3). Inducing or attempting to induce any person to sell
<br />dwelling by representations regarding the entry or prospective
<br />neighborhood of a person or persons of a particular sex, race,
<br />or national origin.
