47a '!HE STATE OF TEXAS '!HE COUNTY OF HAYS I 1 I CONfRAcr KNOW ALL MEN BY 1HESE PRESENTS That the City of San Marcos, Texas, a municipal corporation by and under the I laws of the State of Texas, hereinafter referred to as "City", The, San Harcos Housing Authority, functioning as a quasi-municipal corporation by and under the laws of the State of Texas and of the United States, hereinafter referred to as "Authority", and Bruce G. Conway, of Sah Marcos, Hays COtl.'1ty, Texas, hereinafter referred to as "Conway" enter this contract for the purpose of constructing improvements to Mary Lane and Sturgeon Drive pursuant to the following terms and provisions; to wit: 1. That pursuant to this agreement, twelve hundred eighty-five feet (1285') of Sturgeon Drive situated between property owned by Authority and J;onway and one htmdred sixty feet (160') of Mzry Lane beginning at its intersectlon wi Sturgeon Drive shall be paved, curbed and guttered in a manner so as to conform with standards for new street construction previously approved by the City. II. It is agreed by the parties that the terms of agreement shall supersede any and all previous agreements made by the parties hereto for the construction and improve- ments of the streets previously named herein. III. Authority hereby agrees to contribute toward the improVements to said streets all amounts as crowed by the Authority to be used for the improvements herein provided. I It is understood by "the parties hereto that said amounts approximate the figure of seven thousand five hundred forty-nine dollars ($7,549). ' IV. Conway hereby agrees to bear the cost of seventeen hundred fifty-three feet (1753') of curb and gutter to be constructed along the streets aforementioned, provided however, under no circLUnstances shall the cost of such curb and gutter exceed four thousand three hundred eighty-three dollars ($4,383). v. City hereby agrees to provide all labor and equipment for the construction of said improvements through its force labor account; the anticipated value of such labor and equipment being $8,182.80. Furthermore, City agrees to provide additional materials not covered by Authority's contribution to the construction of the above-referenced improvements; the anticipated value of such additional materials being $4,031.00.
