Th~ City and . the tency concur 'in the use of all. the remaining capital grant <br />funds and Community Development Elock Grant Funds in such amount as is needed. for the <br />payme.nt of the project lands listed in Attachment A, .the total value of which is esti- <br />mated at $450,825.00. <br /> <br />5. During the life of Project No. Tex. A-6, 251 dwelling units were demolished in <br />the project area. All low and moderate income housing required to be provided due to <br />the demolition or removal of residential structures with project funds pursuant to <br />Section 105(h) of Title I of' the Housing Act of 1949, as amended, have been provided. <br />More than 355 dwelling units have been constructed and are identified as to gelleral <br />location on.a map attached hereto as Attachment B and made a part hereof; Such housing <br />not provided would be incorporated and identified in the City's Housing Assistance Plan., <br /> <br />7. All low and moderate income housing requirements with respect to which a pre- <br />dominately residential project was obligated pursuant to Section 105 (f) of Title I of <br />the Housing Act of 1949, as amended, have been met with 24 residential reuse properties <br />having been sold or to be sold. Of the total, 14 have been for low and moderate income <br />residential reuse with 7 of the 14 for lo.~ income. Such units'.are',identified as to <br />general location on said map included as Attachment B hereto. If any such housing re- <br />mains to be provided, it would be incorporated and identified in the City's Housing <br />Assistance Plan and a change in housing obligations or in previously approved land usag <br />affecting housing obligations shall require prior written approval of the Sec:r'etary of <br />BUD as long as the area remains predominately residential under the provisionfi of the <br />applicable Urban Renewal Plan. <br /> <br />I 8. In the. event that the City' should succeed the Agency with respect to any dutie <br />'. activities,. obligations or otherwise connected w.rth completion or carrying out: of the <br />project the City hereby agrees to be bound by the terms of this Agreement and to perfor <br />. 'the Agency's duties, obligations', and activities to the same extent as the Ag.mcy is <br />herein obligated. <br /> <br />9. Any costs or obligations incurred in connection with the project with respect <br />to claims which are disputed, contingent, unliquidated or unidentified and for the pay- <br />ment of which insufficient project funds have been reserved under the financial settle- <br />ment, shall be borne by the City. Such additional expenses may be paid from funds made <br />available from Community Development Block Grant Funds under 24 CFR.570. et seq. <br /> <br />10. Obligations under this Agreement are made specifically subject to the program <br />management requirements.of Subpart (J) of 24 CPR 570.900, et seq. <br /> <br />11.
