<br />Terms of <br />Agricultural Lease at <br />San Marcos Municipal Airport <br /> <br />I <br /> <br />This agreement pertains to the agricultural use of certain <br />lands, herein described, located at the San Marcos Municipal Airport <br />(formerly identified as Camp Gary), situated in Caldwell County, <br />Texas. The agreement is made and entered into by and between the <br />City of San Marcos, Hays County, Texas, herein called Lessor and <br />Widder) , A~ /JaM Sc hlh Fuc/c Of Ie..e <br />herein called Lessee. The accompanying map is made a part of this <br />lease agreement. <br /> <br />I. Description of Demised Property <br /> <br />The demised property is divided into three (3) tracts as <br />described below and identified on the accompanying map. This divi- <br />sion into tracts is made for the purpose of identifying the allowable <br />use of each tract and for allowing a different price to be bid upon <br />each tract. Each bidder must bid upon each tract, since only one <br />agricultural lease will be awarded. <br /> <br />I <br /> <br />TRACT A. Tract A consists of 130 acres, more or less, that are <br />immediately adjacent to the runways and taxiways at the airport. <br />More particularly, it is situated parallel to and 150 feet dis- <br />tant from either side of the center line of each and every run- <br />way and 50 feet from each taxiway center line and it extends 400 <br />feet from the end of each and every runway, between parallel <br />lines of equal width with the width of the runways. Additionally, <br />it includes all of the land bounded on the sides by concrete <br />apron and the segments of runways 8-26 and 12-30 closest thereto, <br />and on the ends by taxiways A and E as shown on the <br />land use map. <br /> <br />TRACT B. Tract B consists of 273 acres, more or less, and is <br />that area situated outside the boundaries of Tract A, but is <br />enclosed entirely by runways or a combination of runways and <br />taxiways. <br /> <br />TRACT C. Tract C consists of 497 acres, more or less, which <br />constitute all other agricultural lands located at the airport <br />not contained within the boundaries of Tract A or B. <br /> <br />II. Care and Use of Demised Property <br /> <br />I <br /> <br />TRACT A. This tract constitutes a part of the runway safet:y <br />zone. As such, Tract A will be sodded and/or sprigged by LeSSeE! with <br />a low-growing, turf-type grass. A turf, once established, will be <br />maintained by Lessee during the entire duration of this lease aCjree- <br />ment. Hay may be made on Tract A, with the restriction that the Lessee <br />aCjrees to keep mowed an area 25 feet wide along the entire edCje of <br />runway 12-30 and taxiway~, and any other runway or taxiway that <br />may become lighted, so that all runway and taxiway liCjhts are kept <br />clearly visable at all times. Lessee agrees to take sufficient care, <br />so as to prevent damage to runway and taxiway lights due to mowing <br />or other agricultural activities. Lessee agrees to reimburse the <br />Lessor for repair or replacement of any runway and taxiway lights that <br />may be damaged as a result of mowing or agricultural activities. <br />
