<br />180-1 <br /> <br />I <br /> <br />who shall cause the Environmental Advisory Committee to <br />consider the environmental impact statement within twenty <br />(20) days following transmittal and the Chairman of the <br />Environmental Advisory Committee shall return said <br />statement with the Committee's recommendation to the <br />Director of Public Works, Upon the completion of the <br />review of the final plat and construction plans, and <br />receipt of the environmental impact statement and the <br />Environmental Advisory Committee's recommendation, the <br />Director of Public Works shall affix his seal to said <br />plat and plans, and transmit said plat, plans, and <br />environmental impact statement to the Commission; or he <br />shall note his objections to said plat, plans, and state- <br />ment in a written memorandum and transmit the said memo- <br />randum, plat, plans, and statement to the Commission. <br /> <br />4. <br /> <br />The Commission shall render a decision on the plat, con- <br />struction plans, and statement within thirty (30) days <br />after transmittal by the Director of Public Works, unless <br />such time is extended by agreement of the subdivider or <br />his agent. Such decision may consist of approval or dis- <br />approval, In those cases the plat, construction plans, and <br />environmental impact statement are disapproved by the <br />Commission, the developer shall be informed, in writing, of <br />the Commission's action. The developer may re-submit the <br />corrected final plat, construction plans, and environmental <br />impact statement to the Director of Public Works, or <br />appeal, in writing, to the Council with a copy to the City <br />Manager; within sixty (60) days of the disapproval date <br />without the submission becoming null and void. <br /> <br />I <br /> <br />5. If desired by the subdivider and approved by the Planning <br />and Zoning Commission, the final plat may constitute only <br />that portion of the approved preliminary plat which he <br />proposes to record and develop. However, such portion <br />shall conform to all the requirements of this Ordinance, <br />and the portion or portions of the subdivision for which <br />the final plit is drawn and submitted for approval shall <br />be in successive orde~ of development as exhibited on the <br />previously approved master development plan. <br /> <br />Section I. <br /> <br />Recordation of Final Plat, <br /> <br />1. After approval of the final plat, construction plans, and <br />environmental impact statement, the Commission shall cause <br />the Director of Public Works to record said final plat <br />with the County Clerk of Hays County upon the subdivider's <br />performance of one of the following: <br /> <br />a. Completion of the construction of required improvements <br />prior to recordation in compliance with subsection 3 of <br />this section; or <br /> <br />b. Filing of security in lieu of completing construction <br />prior to recordation in compliance with subsection 4 <br />of this section. <br /> <br />I <br /> <br />2. In addition to the performance required above, the subdivider <br />shall provide the following to the Director of Public Works: <br /> <br />a. Tax Certificates. Tax certificates showing that no <br />taxes are currently due or delinquent against the property. <br /> <br />b. Waiver. An agreement waiving any claim or claims for <br />damages against the City occasioned by the alteration <br />by the subdivider of the surface of any portion of <br />existing streets and alleys. Said agreement to be <br />required of the subdivider shall be in the following form: <br />
