<br />180_ <br /> <br />CITY OF SAN MARCOS <br />San Marcos, Texas <br /> <br />In accordance with Artic~e VI, Section D, of the <br />City of San Marcos Subdivision Ordinance and in <br />consideration of the approval of <br />Subdivision, <br /> <br />(Name of Owner of Subdivision) <br />does hereby waive any and all claims for damages <br />against the City of San Marcos, Hays County, Texas, <br />occasioned by the establishment of grades or the <br />alteration of the surface of any portion of existing I <br />streets and alleys to conform to the grades estab- <br />lished in the above-named subdivision. <br /> <br />(Signature of Owner of Subdivision) <br /> <br />c.Engineer's Certificate. A certificate, signed by the <br />subdivider's registered engineer that any and all <br />improvements constructed in the subdivision have been <br />completed in accordance with the approved construction <br />plans, and that all monuments and lot markers have been <br />properly located and placed in accordance with this <br />Ordinance, as applicable. <br /> <br />d. A reproducible tracing and one (1) copy of the final <br />plat, together with one (1) reproducible set of <br />construction plans shall be delivered to the Director <br />of Public Works, <br /> <br />e. Guarantee. The subdivider shall furnish to the Dir- <br />ector of Public Works a title opinion or guaranty of <br />title from a licensed attorney or title company <br />authorized by the laws of the State of Texas to write <br />the same, certifying that the signature of all I <br />persons whose consent is necessary to pass clear <br />title to the land being subdivided, together with ' <br />the nature of their interest therein. Said opinion <br />or guaranty shall also state that all acknowledge- <br />ments appear on the proper certification, both as to <br />consent as to the making thereof and affidavits of <br />dedication where necessary. <br /> <br />f. When the subdivider has selected the option provided <br />in subsection I-a of this section, a certificate of <br />dedication of all streets, alleys, parks, easements, <br />and other land intended for public use, signed by the <br />owner or owners and by all other persons, firms, or <br />corporations owning an interest in the property sub- <br />divided and platted, which shall be acknowledged in <br />the manner prescribed by the laws of the State of <br />Texas for conveyance of real property, shall be submit- <br />ted and attached to the final plat. <br /> <br />g. If the subdivider chooses to file security in lieu of <br />completing construction prior to recordation of the <br />final plat, he may utilize one (1) of the following <br />methods of posting security. If the subdivider <br />chooses to file security, the plat shall not be I <br />recorded unless the subidvider has one of the <br />following: <br /> <br />1. Performance Bond: Has filed with the Planning <br />and Zoning Commission a bond executed by a surety <br />company holding a license to do business in the <br />State of Texas, and acceptable to the City, on <br />th~ form provided by the City, in an amount equal <br />to the C'OSt of the improvements required by this <br />Ordinance, and within the time for completion of <br />the improvements as estimated by the Director of <br />Public Works. The performance bond shall be <br />approved as to form and legality by the City <br />Attorney. <br />
