<br />I <br /> <br />I <br /> <br />1- <br /> <br />. <br /> <br />. <br /> <br />A. Where denial of an application is involved, the burden <br />is on the applicant. <br /> <br />B. Where a termination of service is involved, the burden is <br />on the Senior Citizens Director who made the decision to <br />terminate. <br /> <br />C. Where a question of quality of services is involved <br />the burden of proof is upon both parties. <br /> <br />PROCEDURAL ACTION <br /> <br />1. The matter under appeal must be in writing between the <br />applicant and the Senior citizens Director stating <br />the particulars. <br /> <br />2. The applicant and the Senior Citizens Director within 10 <br />days of written notice must initiate efforts in consul- <br />tat~on to solve the dilemma. <br /> <br />3. If satisfaction is not achieved, the applicant or the <br />Senior Citizens Director can appeal to the Community <br />Action Agency Director stating the problem in writing. <br />Within 10 days of this appeal a date must be established <br />for a hearing of the facts and a decision will be rendered. <br /> <br />4. If acceptable finality to all parties from the Community <br />Action Agency Director is not achieved then an appeal can <br />be made to the Executive Committee of the Community Action <br />Agency Inc., of Hays, Caldwell and Blanco Counties whose <br />decision will be final. This appeal must be filed in <br />writing within 10 days of the Community Action Agency Di- <br />rector and a hearing date scheduled within an additional <br />lO day period. <br /> <br />5. All appeal procedures will be conducted in a non-legal <br />manner with parties involved presenting any information <br />they believe relevant to the case. The party initiating <br />the action will proceed first followed by the other party <br />in the case. <br /> <br />3. <br />
