RESOLUTIC~ NO. 1981-13R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING A RELEASE OF A PORTION OF AN EASEMENT GRANTED TO CITY BY ROBERT M. KONE AND THERESA K. KONE AND RE- CORDED IN VOLUME 176, PAGE 495, HAYS COUNTY DEED RECORDS; AUTHORIZING THE MAYOR OF SAID CITY TO EXECUTE SAID RELEASE AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of San Marcos, Texas is the Grantee of an easement from Robert M. Kone and Theresa K. Kone for the construction, reconstruction and maintenance of a public street within the corporate limits of the City of San Marcos, Texas, said street to be known as Kone Street; and, WHEREAS, said easement, granted January 20, 1959, is recorded in Volume 176, Page 495, Hays County Deed Records; and, WHEREAS, a structure currently encroaches On the easement premises granted to City; and, WHEREAS, the City of San Marcos has received a request from Dan Nevares for the release of a two (2) foot stip of said ease- ment premises; and WHEREAS, the City Council of the City o f San Marcos, Texas has determined it would be in the best interest of the public to release said two (2) foot stip; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the Release of Portion of Easement, said Ease- ment granted to the City of San Marcos, Texas by Robert M. Kone and Theresa K. Kone and recorded in Volume 176, Page 495, Hays County Deed Records, a copy of which release is attached hereto and incorporated herein for all intents and purposes, be, and the same is hereby, approved in all respects. PART 2. That the Mayor of the City of San Marcos, Texas, Kenneth V. Kraus, be, and he is hereby, authorized to execute said Release on behalf of the City of San Marcos. PART 3. That this resolution shall be in full force and effect immediately from and after its passage. ADOPTED this 266h day of January, 1981. ATTEST: ayor Sharyl Werner City Secretary
