68 <br /> <br />THE STATE OF TEXAS <br /> <br />COUNTY OF HAYS <br /> <br />RELEASE OF PORTION OF <br />EASEMENT <br /> <br /> The City of San Marcos, a municipal corporation in Hays <br />County, Texas, said City being the Grantee of a certain ease- <br />ment for the construction, reconstruction and maintenance of <br />a public street, said easement from Robert M. Kone and Theresa <br />Kone and filed of record in Volume 176, Pages 494-497, Hays <br />County Deed Records, for and in consideration of ten (10) dollars <br />and other valuable consideration, the receipt and sufficiency of <br />which are hereby acknowledged, does hereby RELEASE the owner and <br />owners and parties interested in the following described premises: <br /> <br />Being all of LOt Six(6) of the Rogers Subdivision <br />No. 1, in Hays County, Texas according to the map <br />or plat of said subdivision recorded mn Volume 131 <br />page 477, of the Deed Records of Hays County, Texas, <br />being the same real property as that conveyed by <br />and described in three deeds, one of said deeds being <br />from Robert M. Kone and Theresa K. Kone to Dan Nevares, <br />Jr. and Rosemary R. Nevares dated April 10, 1971 and <br />recorded in Volume 242, Page 865-867, Hays County Deed <br />Records, the second of sai~d deeds being from B.J. <br />Festervan, etux to Robert M. Kone, dated March 19, 1953, <br />recorded in Volume 155, pages 472-474, of the Deed <br />Records of Hays County, Texas, the third of said deeds <br />being from L.W. Kone, etux, to Robert M. Kone, etux <br />dated March 19, 1951, recorded in Volume 149, pages 381- <br />382, of the Deed Records of Hays County, Texas <br /> <br />from the rights and benefits accuring to said City of San Marcos, <br />Texas under the terms of said easement which pertain to the follow- <br />ing described portion of said easement: <br /> <br />Being a 249.4 sq. ft. parcel of land to be released <br />by the City of San Marcos, said parcel being a 2.00' <br />stip of land to be taken out of Kone Street, a <br />street in the City of San Marcos, and described in <br />Volume 176, Page 495, HaYs County Deed Records, Kone <br />Street was also a part of Lot No. 6, Block 2, of the <br />Rogers Subdivision No. 1, and is recorded in Volume <br />131, Page 478, Hays County Deed Records. The 2.00' <br />strip of land to be released is described as follows... <br /> <br />Commencing at a point that is the intersection of the <br />Southwest street line of Kone Street and the Northwest <br />street line of Linda Drive, said point is also the East <br />corner of a .57 acre parcel of land that was formally a <br />part of Lot No. 6, Block 2, of the Rogers Subdivision <br />No. 1, as recorded in Volume 131, Page 479, and the most <br />Southerly corner of the parcel herein described, <br /> <br />Thence N 46o-23' W, along the Southwest street line of <br />Kone Street a distance of 124.73', to a point, said <br />point being the intersection of the Southwest street <br />line of Kone Street and the Southeast highway line of <br />Interstate 35, and marks the North corner of the .57 <br />acre parcel previously described and the most Westerly <br />corner of the herein described parcel. <br /> <br />Thence, N 50°-32'E, along the Southeast highway line <br />of Interstate 35 extended, a distance of 2.01' to a point, <br />said point being the most Northerly corner of the herein <br />described parcel. <br /> <br /> <br />
