-5- <br /> <br />of Lessee's property, or if Lessee makes an assignment for the <br />benefit of creditors or petitions for or enters into an agreement, <br />or suffers this lease to be taken under any writ of execution or <br />attachment, or if this lease shall pass to or dissolve upon by law <br />or otherwise, one other than Lessee except as herein provided, <br />then in any one or more such events~ upon City serving thirty (30) <br />days written notice of cancellation upon Lessee specifying the <br />nature of said default and if, at the expiration of said thirty (30) <br />days, Lessee shall have failed to comply with or remedy such default, <br />then this lease and the term thereunder, shall at the option of City, <br />terminate and come to an end on the date specified in such notice of <br />cancellation, and Lessee shall quit and surrender the demised premises <br />to City as if the term hereunder was ended by the expiration of the <br />time fixed herein, and Lessee shall remain liable for any unpaid <br />amount owed under Part IV. <br /> <br /> If City shall be in default in performing any of the terms or <br />provisions of this lease required on its part to be performed, and <br />Lessee shall give City notice in writing of such default, and if <br />City shall fail to cure such default within thirty (30) days after <br />service of such notice, then an in such event, the lease shall be <br />terminated and cancelled. <br /> <br /> Prior to the event Lessee agrees to provide City with progress <br />reports and plans as required by the City. <br /> <br /> XVI I. <br /> <br /> Lessee shall not assign or sublease this lease without first <br />obtaining prior written approval of City, which approval shall not <br />be unreasonably withheld, and further provided that no sublease or <br />assignment of lease shall ever by given except for the purposes <br />and uses authorized hereby. <br /> <br /> XVIII. <br /> <br /> The foregoing instrument in writing constitutes the entire <br />agreement herein, ;there being no other written nor parole agreement <br />with any officer or employee of the City. No amendment, modification <br />or alteration of the terms hereof shall be binding unless the same <br />shall be in writing, dated subsequent to the date hereof and duly <br />executed by the parties hereto. <br /> <br /> This Lease Executed in Duplicate Originals on the 27th day <br /> <br /> <br />
