<br />I <br /> <br />I <br /> <br />I <br /> <br />. <br /> <br />. <br /> <br />CO~lMISSIONERS COURT ORDER NO._ <br /> <br />A COURT ORDER BY THE COUNTY OF HAYS, TEXAS DESCRIBING <br />THE FUNCTIONS, DUTIES, AND, POWERS OF SHELTER ~1ANAGERS <br />DURING NATIONAL EMERGENCIES; PROVIDING A PENALTY; AND <br />DECLARING AN EMERGENCY. <br /> <br />BE IT ORDAINED BY THE C01-lMISSIONERS COURT OF THE COUNTY OF HAYS, TEXAS: <br /> <br />Section 1. In case of national emer~ency, Public Shelter Managers duly <br /> <br />appointed by the Civil Defense Director, shall open public shelters, take <br /> <br />charge of all stocks of food, water, and other supplies stored in said shelter, <br /> <br />admit the public according to the county's shelter use plan and take whatever <br /> <br />control measures are necessary for the protection and safety of the occupants. <br /> <br />Section 2. Shelter Managers are authorized to use reasonable restraint <br /> <br />against those who refuse to cooperate with the routine-,of shelter living <br /> <br />under emergency conditions. Refusal to carry out the orders of the Shelter <br /> <br />Manager and his appointed staff shall be deemed a misdemeanor punishable by <br /> <br />a' fine of not more than Two Hundred Dollars ($200.00). <br /> <br />Section 3, The fact that there is presently no authorization of power <br /> <br />for Shelter Managers during a national emergency in the County of Hays, <br /> <br />and the fact that such regulations are needed for the protection of the <br /> <br />safety and welfare of the citizens of the County of Hays during a national <br /> <br />emergency, cl;'eates an emergency and an iInperative public necessity of the imme- <br /> <br />diate preservation of. the public welfare and safety which requires suspension <br /> <br />of the rule requiring court orders to be read on three separate days before <br /> <br />the final passage thereof, and such rules are hereby suspended and this court <br /> <br />order shall be effective from and after its final pasage, and it is so ordained. <br /> <br />PASSED AND APPROVED THIS <br /> <br />DAY OF <br /> <br />,19_. <br /> <br />ATTEST: <br /> <br />County Clerk <br /> <br />County Judge, County of Hays <br /> <br />County Attorney <br />
