<br />. <br /> <br />. <br /> <br />" <br /> <br />ORDINANCE NO. <br /> <br />AN ORDINANCE BY THE CITY OF SAN }!ARCOS, TEXAS, DESCRIBING <br />THE FUNCTIONS, DUTIES, AND POWERS OF' SHELTER MANAGERS <br />DURING NATIONAL EJolERGENCIES; PROVIDING A PENALTY; AND <br />DECLARING AN EMERGENCY. <br /> <br />BE IT ORDAIl\'ED BY THE CITY COUNCIL OF THE CITY OF SAN }!ARCOS, TEXAS: <br /> <br />Section 1. In case of national emergency, Public Sh~lter Managers duly <br /> <br />appointed by the Civil Defense Director, shall open public shelters, take III <br /> <br />charge of all stocks of food, water, and other supplies stored in said shelter, <br /> <br />admit the public according to the city's shelter use plan and take whatever <br /> <br />control measures are necessary for the protection and safety of the occupants. <br /> <br />Section 2. Shelter Managers are authorized to use reasonable restraint <br /> <br />against those who refuse to cooperate with the routine of shelter living <br /> <br />under emergency conditions, Refusal to carry out the orders of the Shelter <br /> <br />Manager and his appointed staff shall be deemed a misdemeanor punishable by <br /> <br />t <br /> <br />a fine of not more than Two Hundred Dollars ($200.00). <br /> <br />Section 3. The fact that there is presently no authorization of power <br /> <br />for Shelter Managers during a national emergency in the City of san Marcos, <br /> <br />and the fact that such regulations are needed for the protection of the safety <br /> <br />and welfare of the citizens of the City of San Marcos during a n~tional III <br /> <br />emergency, creates an emergency and an imperative public necessity of the <br /> <br />immediate preservation of the public welfare and safety which requires suspension <br /> <br />of the rule requiring ordinances to be read on three separate, days befoJ:'e the <br /> <br />final passage thereof, and such rules are hereby suspended and this ordinance <br /> <br />shall be effective from and after its final passage, and it is so ordained. <br /> <br />PASSED AND APPROVED THIS <br /> <br />DAY OF <br /> <br />, 19 <br /> <br />ATTEST: <br /> <br />City Clerk <br /> <br />Mayor, City of San Marcos <br /> <br />City Attorney <br /> <br />.1.-- <br />
