<br />Contract Number 161 <br /> <br />CONTRACT <br /> <br />THIS CONTRACT AND AGREEMENT is entered into by and between the agencies <br />shown below as Contracting Parties. <br /> <br />I. CONTRACTING PARTIES: <br /> <br />The Receiving Agency: City of San Marcos <br /> <br />The Performing Agency: Southwest Texas State University-Edwards <br />Aquifer Research and Data Center. <br /> <br />II. STATEMENT OF SERVICES TO BE PERFORMED: <br /> <br />BI-WEEKLY LABORATORY ANALYSES OF SAMPLES FOR WATER QUALITY (15/EVERY <br />OTHER WEEK) WILL BE PERFORMED FOR 24 WEEKS. THESE ANALYSES WILL <br />INCLUDE TOTAL KJELDAHL NITROGEN AND NITRATES, PHOSPHATES AND SULFIDES. <br /> <br />The Performing Agency, hereinafter referred to as the University, will <br />provide services for the Receiving Agency, hereinafter referred to as the <br />City. The parties agree that this contract will cover a period of 24 weeks <br />from March 22,1981 to September 1,1981. <br /> <br />The scope and coverage of the services to be provided under this contract <br />are described and included in the attached proposal prepared by Dr. Glenn <br />Longley, Director, Edwards Aquifer Research and Data Center, Southwest Texas <br />State University, which proposal is marked Exhibit IIAII, attached hereto, and <br />incorporated into this contract in its entirety by specific reference. <br />Budgetary changes may be made at the discretion of the Project Director <br />provided they do not exceed the total due from the City. Any other changes, <br />modifications, amendments or renewals to such proposal must be made with the <br />prior written approval of the City Manager or his authorized representative. <br />The University shall provide the services hereinabove described by and <br />through Dr. Glenn Longley, as Director, and his assistants and staff. <br /> <br />The University shall establish and follow such accounting, budgetary and <br />other fiscal procedures as shall be necessary for the proper and efficient <br />administration of the project and shall maintain and retain supporting fiscal <br />documents. <br /> <br />The University agrees to comply with all applicable federal and state laws <br />relative to the giving of equal opportunity without regard to race, color, <br />creed, sex or national origin. <br /> <br />page 1 <br />
