<br />95 <br /> <br />ORDINANCE NO. 1974 - 67 <br /> <br />I. <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, ESTABLISHING <br />THE CLASSIFIED AND UNCLASSIFIED SERVICE OF CERTAIN PERSONNEL <br />EMPLOYED BY SAID CITY; ESTABLISHING A PERSONNEL APPEAl BOARD; <br />DEFINING SAID BOARD'S DUTIES, POWERS, SCOPE OF RESPONSIBILITY, <br />LIMITATIONS, ETC; AND PROVIDING FOR AN APPEAL PROCEDURE WITHIN <br />THE CLASSIFIED SERVICE. <br /> <br />WHEREAS, the City Council of the City of San Marcos, Texas, desires to establish <br />a classified anq unclassified service program within the personnel organizational <br />structure of said City; and, <br /> <br />WHEREAS, the City Council desires to establish an appeal procedure for the <br />determination of appeals from disciplinary action; and, <br /> <br />WHEREAS, the City Council recognizes a need for a detached third party to hear <br />and reconcile said appeals within a framework established by the City Council; <br />now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That there be, and there is hereby, established a new section in <br />Chapter 2, Article III, Division 1 of the Code of Ordinances of the City of <br />San Marcos, Texas, numbered 2-27 and entitled "Division of the City Service" so <br />as to read as follows: <br /> <br />Section 2-27. Division of the City Service. <br /> <br />All offices and positions of trust, emolument, or employment in the service <br />of the City of whatever function, designation or compensation, excluding <br />members of the Police and Fire Departments, appointed to such positions in <br />substantial compliance with the provisions of Article 1269m, Texas Revised <br />Civil Statutes, are hereby divided into the unclassified and classified services. <br /> <br />I <br /> <br />A.) Unclassified Services. <br /> <br />The unclassified services shall comprise; <br /> <br />1.) All elected officials; <br />2.) The City Attorney and all deputies or assistant City.Attorneys; <br />3.) The City Secretary and all deputies or assistants; <br />4.) The City Manager and all deputies or assistant city managers; <br />5.) Temporary employees (those employees employed to perform services <br />of a limited per~od of temporary character not to exceed four (4) <br />consecutive calendar months); <br />6.) Part-time employees performing services in which total hours worked <br />in a twelve (12) .consecutive month period do not exceed 1040 hours; <br />7.) Department Heads and staff members directly subordinate to the <br />City Manager; <br />8.) Members of all boards, commissions, and committees appointed by <br />the Mayor, or by the Mayor and City Council, or by the City Manager <br />who serve with or without compensation; or <br />9.) Probationary employees as defined herein. <br /> <br />B.) <br /> <br />Classified Services. <br /> <br />I <br /> <br />The classified service shall include all other positions, not included <br />in Paragraph A above, now existing or hereafter created in substantial <br />compliance with the Classification Plan of the City of San Marcos. <br /> <br />SECTION 2. That there be, and there is hereby, established a new sect.ion in <br />Chapter 2, Article III, Division 1 of the Code of Ordinances of the City of <br />San Marcos, Texas, numbered 2-28 and entitled "Personnel Appeal Board" so as to <br />read as follows: <br />
