<br />95-a <br /> <br />Section 2-28. Personnel Appeal Board. <br /> <br />There is hereby created a municipal Personnel Board consisting of three <br />(3) persons who shall be appointed by the City Manager with the consent of <br />the City Council. <br /> <br />A. ) Qualifications. Members of the Personnel Board shall be not less <br />than twenty-five (25) years of age and shall be resident citizens <br />of the City of San Marcos for a period of not less than two (2) <br />continuous years immediately preceding appointment. No Board member <br />shall hold any salaried public office.or compensated employment; <br />or shall hold any City appointment to any other board, commission, I <br />or committee; and shall not be personally or financially interested <br />in any contract with the City except such contracts as shall be let <br />upon competitive bids. <br /> <br />B.) Representation. There shall be at all times, one member of the Board <br />appointed from the citizen employee-group, one member from the citizen <br />employer-group, and one member from the citizen professional-group. ~ <br /> <br />C.) Compensation. Members of the Personnel Board shall serve without <br />compensation. <br /> <br />D.) Nepotism. No member of the Personnel Board shall participate in Board <br />proceedings which involve any employee or participant who is related <br />to said Board member. Relationship, as herein defined, shall extend <br />to all persons related as closely as first cousins when the relation- <br />ship is by blood, or more closely related than first cousin where the <br />relationship is through marriage; and shall include cases of husbands <br />of sisters-in-law and wives of brothers-in-law. <br /> <br />E.) Term of Office. Board members shall serve for a period of three (3) <br />years, or until a successor is appointed, confirmed, or qualified, <br />except as herein provided in this section for initial appointment. <br />Any vacancies in said Board, caused by death, resignation, or other- <br />wise, shall be filled by the manner herein specified, and such <br />appointment shall be for the unexpired term of the retiring Board <br />members. <br /> <br />I <br /> <br />The Board members first appointed after the effective date of the <br />Ordinance creating said Board shall hold office as follows: <br />1.) One shall serve for a period of three (3) years, <br />2. ) One shall serve for a period of two (2) years, and <br />3. ) One shall serve for a period of one (1) year; <br /> <br />their terms to be decided by appointment and designation of the Mayor. <br /> <br />F.) Election of Chairman. The Personnel Board shall, on the first regular <br />meeting after appointment, elect one of their members to act as Chair- <br />man and one to act as Vice-Chairman at the first regular. meeting in <br />January of each calendar year. <br /> <br />G.) Scope of Responsibilities. The Personnel Board shall hold meetings as <br />required to conduct business and discharge duties as herein specified. <br />Such meeting shall be posted in accordance with Article 6252-17, Revised <br />Civil Statutes of Texas ,(925) now or as hereafter amended. Two (2) <br />members of the Board shall constitute a quorum. It shall be the duty <br />of the Board: <br /> <br />1.) To hear and determine appeals of Classified employees from disciplin- I <br />ary suspension as defined by the Personnel and Compensation <br />Administration Plan of the City of San Marcos. <br /> <br />2.) To hear and determine appeals of Classified employees from discharge <br />as defined by the Personnel and Compansation Administration Plan <br />of the City of San Marcos. <br /> <br />3.) To hear and determine appeals of Classified employees from demotion <br />or reduction in permanent rank or classification as defined by the <br />Personnel and Compensation Administration Plan of the City of San <br />Marcos. <br />
