96-a 1.) The selection of all fixed base operators and other lessees located at the Municipal Airport. 2.) The terms, conditions, duties, responsibilities, consideration, and other lease provisions to be contained in all lease arrangements concerning airport property. 3.) All matters affecting airport management. 4.) Methods and matters in recruiting and creating interest in the Municipal Airport. 5.) Planning and developing airport services and expansion. 6.) Submitting a budget to the City Manager for the expenditures of revenues from aeronautical and non-aeronautical sources at the Municipal Airport for inclusion in budget preparation for each fiscal year of the City to be submitted to the City Council for final Council approval and adoption in the annual budget. I Section 31-5. Appeal Hearing Board. The Airport Commission shall sit as an appeal hearing board in an effort to assist the City Council and the city staff in settling disputes and controversies concerning all fixed base operations and other lease arrangements held by individuals or business entities at Municipal Airport. The Commission shall have the power to hear the production of evidence from the parites involved and to solicit evidence from the city staff before making a recommendation to the City Council for the resolution of all disputes and controversies. Upon conducting a nearing in which all interested parties have had an opportunity to be heard, the Airport Commission shall submit to the City Council, in writing, its findings and determinations, accompanied by a recommendation for the final resolution of the matter. Section 31-6. Limitations on Commission. The Airport Commission is not, nor shall be, authorized to incur or create any debt unless prior approval has been obtained from the City Council. Nor shall the Commission be empowered to enter into any contracts, leases, or other legal obligations binding upon the City of San Marcos without having first obtained approval from the City Council. Nor shall this article be interpreted so as to authorize the Commission I or its members to hire airport personnel or direct airport personnel in the execution of their duties. SECTION 2. This Ordinance shall take effect ten (10) days from and after its final passage. PASSED AND APPROVED on first reading October 14, 1974. PASSED AND APPROVED on second reading October 30, 1974.
