<br />96-a <br /> <br />1.) The selection of all fixed base operators and other lessees <br />located at the Municipal Airport. <br />2.) The terms, conditions, duties, responsibilities, consideration, <br />and other lease provisions to be contained in all lease <br />arrangements concerning airport property. <br />3.) All matters affecting airport management. <br />4.) Methods and matters in recruiting and creating interest in the <br />Municipal Airport. <br />5.) Planning and developing airport services and expansion. <br />6.) Submitting a budget to the City Manager for the expenditures of <br />revenues from aeronautical and non-aeronautical sources at the <br />Municipal Airport for inclusion in budget preparation for each <br />fiscal year of the City to be submitted to the City Council for <br />final Council approval and adoption in the annual budget. <br /> <br />I <br /> <br />Section 31-5. Appeal Hearing Board. <br />The Airport Commission shall sit as an appeal hearing board in an <br />effort to assist the City Council and the city staff in settling <br />disputes and controversies concerning all fixed base operations and <br />other lease arrangements held by individuals or business entities <br />at Municipal Airport. The Commission shall have the power to hear the <br />production of evidence from the parites involved and to solicit <br />evidence from the city staff before making a recommendation to the <br />City Council for the resolution of all disputes and controversies. <br />Upon conducting a nearing in which all interested parties have had <br />an opportunity to be heard, the Airport Commission shall submit to <br />the City Council, in writing, its findings and determinations, <br />accompanied by a recommendation for the final resolution of the matter. <br /> <br />Section 31-6. Limitations on Commission. <br />The Airport Commission is not, nor shall be, authorized to incur or <br />create any debt unless prior approval has been obtained from the City <br />Council. Nor shall the Commission be empowered to enter into any contracts, <br />leases, or other legal obligations binding upon the City of San Marcos <br />without having first obtained approval from the City Council. Nor <br />shall this article be interpreted so as to authorize the Commission I <br />or its members to hire airport personnel or direct airport personnel <br />in the execution of their duties. <br /> <br />SECTION 2.
