<br />THIS AGREEMENT MADE AND ENTERED INTO on
<br />by and between the City of San Marcos,apol
<br />State of Texas, acting by and through its Ma
<br />Lessor, and John J. Stok~s, Sr. dba/Redbird
<br />Lessee.

<br />PART I. Lessor for the consideration hereinafter set out,does
<br />hereby lease, rent, let, and demise unto Lessee the following described
<br />buildings and facilities in conjunction therewith located onCaldwel.l
<br />County, Texas,. at San Marcos Municipal Airport (formerly known as the
<br />Camp Gary Airport.) Said airport tract is more fuUy described in the
<br />deed between said City of San Marcos and the United States of America,
<br />dated February 15, 1966, to-wit: Hangar building, the apron,one
<br />wooden building, parking lot and tied own area approximately 557' x
<br />500' adjacent thereto, together with the use of all utilities on said
<br />leased premises as well as the rights of ingress and egress in, on
<br />and across said airport property, and the roads, streets, runways, and
<br />other ways located on said lans.

<br />PART II. Lessee shall use the herein leased bui Idings, . and the
<br />facilities in conjunction therewith, solely for aerol1alltical and
<br />related activities, including hangar rental services, .tiedownservices
<br />for aircraft, machine shops, parts, gasoline and petroleum product sale
<br />services, and similiar activities.

<br />PART III. This lease: shall be for a term of one (1) year,
<br />commencing on the 1st day of January, 1975, and .endingol1 the Slst day
<br />of December, 1975. In consideration for this. lease, Lessee will pay
<br />to Lessor, the sum of Ten Dollars ($10.00). duringthe'\;ermhereof,
<br />payment being due upon the execution hereof, as rental payable in
<br />advance.

<br />PART IV. In addition to the above-described leaSed property, and
<br />rights incident thereto, Lessee will provide for the sale oLgasoline
<br />dtlring th~ term of this lease agreement. The Lessee will establish
<br />and maintain air-to-ground and ground-to-air communications to
<br />accomodate arriving and departing aircraft during daylight hours.

<br />pART V. Lessee further agrees that it will maintain and keep in
<br />good repair the interior of the leased buildings, and shall return same
<br />to Lessor upon termination of this lease in as good condition as said
<br />premises are at this time, reasonable wear and tear and acts of God
<br />and public enemies only elCcepted. Lessee further covenants that it
<br />wi 11 conduct its business in a good and businesslike mannerasa
<br />reasonable prudent operator would do and will suffer no waste or other
<br />depredations to the leased property.

<br />PART VI. Lessee will secure at'its expense and cost 0.1.1 licenses
<br />and certificates,. required by governmental agencies having jurisdiction
<br />over such matter, that may be required in the conduct of its business on
<br />silid premises. Lessor retains fOr itself the right to inspect the
<br />leasedpremi!;es at any and all reasonable hours and may designate in
<br />writing an agent for the purpose of inspecting said premises for it
<br />provided, however, Lessee shall !lot be responsible for any damage to
<br />the per"on. or property of Lessor or Lessor's agents ,incurred during
<br />the course of such inspection.

<br />PART VIla. Lessee a.lso binds and obligates itself to hold Lessor
<br />harmless from any claims,eitherfor personal or bodilyin,jury. or
<br />property damage on the part of it s elf, it s agents or emp loyees, or on
<br />the part of its guests,customers or licensees, or other third persons,
<br />for daml',ges or .injuries incurred on or. about the .leased premises; alld
<br />Lessee billds and obligatesitseHto take out, pay for~ and keep in
<br />full force during the existance of this lease,as ~eUas any renewal
<br />
