Lessor reserves the right to further develop and improve <br />the remaining property constituting the San Marcos Municipal Airport <br />exclusive of fixed base operations ,,"without interference or hindrance <br />from Lessee, as well as the right. to lease the remainij1g lands .of said <br />airport to other parties for aeronautical purposes. <br /> <br />PART IX. Lessor further reserves the right to protect the aerial <br />approaches to the airport against all obstructions, and Lessee shall <br />not alter or otherwise.change the leased. premises in any manner that <br />would, in the ?pinionof Lessor, constitute a hazard to. aircraft. <br /> <br />I <br /> <br />PART X. Lessee agrees to operate the leased premises for the use <br />and benefit of the public and make available of its facilities to <br />the public without allY un!j~stdiscrimination, and to refrain from <br />imposing or levying discriminatory or otherwise unreasonalhle charges <br />or fees for any use of the herein leased premises. .I't: is understood <br />and agreed between the parties hereto "that.nothing hereincontaineg <br />shall be construed as granting an exclusive right to Lessee within <br />the meaning of Section 308 of the Federal Aviation Act of 1958. <br /> <br />PART XI. Lessee. shall n.ot have the right to assign this lease or <br />sub-let the said premises'imdfhiilke or in part, without the written <br />consent of Lessor;;and in the event such consent of Lessor is obtal\1ned <br />Lessee shall remain liable for the full and complete performance of all <br />of the covenants and obligations herein contained, unless expressly <br />relieved therefrom by Lessor. <br /> <br />PART XII. This lease shall be subordinate to the provisions .of <br />any existing or future agreement entered into between the Lessor_and <br />the United States. <br /> <br />I <br /> <br />PART XIII. If Lessee defaults in the payment of the consideration <br />speci;lHed in Part tII. above, or if it willfully neglects or refuses to <br />C<irry out any of the provisions or requirements of this lease incumbent <br />upon it, the ~essor shall have the right to terminate this lease; however, <br />Lessor shall first mail written notice to the Lessee, specifying the <br />'l1J!olations of this lease by Lessee. If such violations are notborrected <br />within ten (10) days from the date of mailing of such notice, this lease <br />shall be t~rminated. At the expiration of this lease, as specified in <br />PART I II. above, or the t ermina ti on her eof, as specifi ed in this Part X III" <br />Lessee shall peaceably deliver possession of the premises to Lessor, If <br />Lessee fails or refuses to peaceably deliver possession of the premises at <br />such expiration or termination, Lessor shall have the right to enter into <br />and upon the premises, retlosses them, expel Lessee, and remove its effects, <br />all without being guilty of trespass and without prejudice to any remedies <br />Lessor may otherwise have. <br /> <br />PART XIV. Lessee, agents employees will not discriminate agaiftst <br />any person or class.of persons by re.ason of race, colo~, creed or national <br />origin in providing any service or in the sue of its facilities providlld <br />for the public, in any manner prohibited by PART XIV in Feder"l AviatiOn <br />Regulations. <br />
