(g) Nothing in this section is intended to apply to or affect city ordinances or <br />policies related to the extension of wastewater facilities for developments in the <br />subdivision platting process. <br />(h) Nothing in this section is intended to abrogate or diminish in any manner <br />the authority of the environmental health department to pursue any remedy for the <br />correction of an imminent threat to health pertaining to the condition or maintenance of <br />an on-site sewage system. <br />Sec. 86.153. Duties and powers of the department. <br />The department is the designated representative for the enforcement of this <br />division within the city. The department has the following duties and powers: <br />(1) To resolve any question regarding interpretation of the On-site Sewage <br />Facility Rules. <br />(2) To enforce the rules and to make appropriate recommendations to proper <br />city officials when instances of noncompliance with the rules have been <br />determined. <br />(3) To make inspections of proposed, new and existing on-site sewage <br />• facilities. <br />(4) To collect fees set by the city council to recover the reasonable costs <br />incurred in administering and enforcing the rules. <br />(5) To make semi-annual reports to the TNRCC on all actions, including legal <br />actions, taken concerning these rules. <br />(6) To investigate nuisance complaints within 21 days of receipt and to <br />resolve or make substantial progress toward resolving validated <br />complaints within 30 calendar dates. <br />(7) To perform all other duties necessary to meet the requirements of the <br />rules. <br />Persons aggrieved by an action or decision of the department may appeal the <br />action or decision to the city council. <br />Sec. 86.154. Permit required to install on-site sewage facility; fees. <br />(a) It is unlawful for a person to cause or allow the installation of an on-site <br />sewage facility without first obtaining a permit from the department. <br />• <br />17
