(b) An application for an on-site sewage facility permit must be submitted on <br />forms provided by the department, and must be accompanied by the fee set by the city <br />• <br />council. <br />(c) The department will issue a permit if the application complies with the <br />rules and with all city ordinances. The department will deny a permit if the application <br />does not fully comply with the rules and with all city ordinances. <br />(d) The department will charge separate fees set by the city council for <br />percolation test performance inspection of existing septic systems appeals and <br />professional design review. <br />Sec. 86.155. Inspection of new facility installation. <br />Each new on-site sewage facility shall be inspected and approved by the <br />department prior to the final covering of the facility. The applicant or registered installer <br />shall notify the department that an inspection is desired at least five working days pnfor to <br />the need for inspection. The applicant or registered installer shall provide whatever <br />reasonable assistance the department requests in order to make the inspection The <br />applicant or registered installer must be present at the time of the inspection for that <br />facility. <br />Sec. 86.156. Inspection of existing facilities. • <br />(a) The department may routinely inspect existing on-site sewage facilities to <br />assure continued compliance with these rules The department will inspect any on-site <br />sewage facility that is believed to be causing pollution. a threat to the public health or <br />nuisance conditions. or to be illegally installed or altered. <br />b) If it is found that any of these conditions exists upon inspection of a <br />facility, the department will notify the owner of the facility in writing of the violation and <br />what must be done to achieve compliance. A reasonable amount of time to correct the <br />violation will be set in the notice but in no event will it be greater than 30 calendar days <br />The department will reinspect the facility at the expiration of the allotted time. <br />(c) If the facility is found to be in compliance, a license will be issued or the <br />existing license will be modified. <br />(d) If the facility is found to be noncompliant, appropriate enforcement action <br />will be taken. <br />Sec. 86.157. Emergency repairs. <br />It is unlawful to perform a repair to an on-site sewage facility without first <br />obtaining a permit from the department. It is a defense to prosecution under this section if , <br />the repair is an emergency and: <br />18
