'," 1.972 -,41 AN ORDINANCE APPROVING AND ADOPTING MINOR AMENDMENT NO. 1 TO THE URBAN RENEWAL PLAN FOR NDP PROJECT TEX. A-6, THIRD ACTION YEAR, AND DIRECTING THAT SAID CHANGE BE FILED AS PART OF THE URBAN RENEWAL PLAN FOR SAID PROJECT, AND DECLARING AN EMERGENCY. I WHEREAS, the City has adopted a Redevelopment Plan known as the Urban Renewal Plan for NDP Project Tex. A-6, Third Action Year; and, WHEREAS, the Urban Renewal Agendy has now proposed Minor Amendment No. 1 to said Plan for the purpose of effectuating a change in land use concerning a small irregular shaped portion of land located in the project boundaries near the intersection of Colorado and Water Street, from Community to General Business Use; and, WHEREAS, it is necessary to effectuate a change in land use concerning a rectangular trace of land bound on the North by Cheatham Street, on the West by McKie Street, and on the East by McGehee Street, and also known as the 300 Block of the South side of Cheatham Street; and, WHEREAS, said Minor Amendment No.1 has been submitted to and approved by the Board of Commissioners of the Urban Renewal Agency by Resolution dated November 6, 1972; and, I WHEREAS, in addition said Minor Amendment No.1 has been submitted to the Planning Commissioner of the City of San Marcos and received its favorable recommendation and said recommendations have been forwarded to this body; and, WHEREAS, said Plan, as amended, will conform to the general plan for redevelopment of the City as a whole; and, WHEREAS, the provisions of the Texas Urban Renewal Law, Article 1269L-3, Section 7e of the Vernon's Annotated Civil Statutes of Texas regarding modifications in Urban Renewal plans have been complied with. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, THAT: SECTION 1. Minor Amendment No. 1 consisting of 1 page of textual material and an amended exhibit Land Use Map ND-401-CC and accompanying survey changing the land use as depicted therein of a small irregular shaped tract of land from Community Unit District, or Public Use, to General Business Use, all a part of the Urban Renewal Plan for NDP Project Tex. A-6, is hereby ratified, adopted and approved. I SECTION 2. Minor Amendment No.1 also includes nine (9) lots along the South curbline of the 300 Block of Cheatham Street bound on the East by McGehee Street, south by an Alley, and West by McKie Street identified as Parcels 20R-l through and including 20R-9 from Single Family Use to General Business Use, all a part of the Urban Renewal Plan for NDP Project Tex. A-6, is hereby ratified, adopted and approved.
