ORDINANCE NO. 1981-48 <br /> <br />96 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, ORDERING A SPECIAL ELECTION ON AUGUST <br />8, 1981, FOR THE PURPOSES OF ELECTI~S A MAYOR OF SAID <br />CITY AND SUBMITTING Ai~LNE~7i~ TO ~ ~ OF SA~D <br />CITY; M3~KING PROVISIONS FOR THE CC6KYJCT OF T5~ ELECTION <br />AND DECLARING AN E~.~GENCf. <br /> <br /> WHEREAS, the Mayor of the City of San Marcos, Texas, Kenneth V. Kraus, <br />elected for a two year term on May 10, 1980, resigned said position on <br />March 4, 1981; and, <br /> <br /> WHEREAS, the first date authorized by the Texas Election Code on which <br />an election may be held to elect a person to fill the unexpired term of <br />former Mayor Kraus is August 8, 1981; and, <br /> <br /> WHEREAS, Article 1165, Texas Revised Civil Statutes, provides that <br />amendments to an existing charter of a home rule city may not be submitted <br />to the resident qualified voters more than once every two years; and, <br /> <br /> WHEREAS, the City of San Marcos, Texas, a home rule city by virtue <br />of a home rule charter adopted February 24, 1967, last amended its charter <br />on April 9, 1979; and, <br /> <br /> WHEREAS, Article 1170~ Texas ~evised Civil Statutes, provides that a <br />governing body wishing to sub~it amendments to an existing charter must do <br />so at an election to be held not less than thirty (30) days nor more than <br />ninety (90) days after the passage of the ordinance providing for said sub- <br />mission; and, <br /> <br /> WHEREAS, the City Council of the City of San Marcos desires to submit <br />amendments to the San Marcos City Charter to the resident qualified voters <br />of the city on August 8, 1981, a date not less than thirty (30) days nor <br />more than ninety (90) days hence; nc~, therefore, <br /> <br />BE IT ORD~ BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br /> SECTICN 1. That a special election is hereby called and ordered <br />for August 8, 1981 for the purposes of electing a mayor of the City of San <br />Marcos and sutkmit~g amendments to the city charter to the resident <br />qualified voters of said city. <br /> <br /> SECTION 2. That the following propositions to amend the City Charter <br />shall be submitted to the resident qualified voters of the City of San <br />Marcos, Texas, on said date for their action thereupon: <br /> <br />FOR/AGAINST: <br /> <br />Proposition No. 1 <br /> <br />Amend Section 4.02 to require city council approval <br />for the city manager to assign duties to the city <br />secretary. <br /> <br />FOR/AGAINST: <br /> <br />Proposition No. 2 <br /> <br />Amend Section 4.03(e) to change the title of the <br />alternate judge of the municipal court to that of <br />associate judge. <br /> <br />FOR/AGAINST: <br /> <br />Proposition No. 3 <br /> <br />Amend Section 7.01 to delete the requirement that <br />members of the city planning and zoning commission <br />Own real property .in the city. <br /> <br />FOR/AGAINST: <br /> <br />Proposition No. 4 <br /> <br />Amend Section 7.05(f) to require the planning and <br />zoning ccumission to submit to city council a <br />recom~anded list of capital improvements at least <br />ninety days prior to the beginning of the fiscal year. <br /> <br /> <br />
