115 <br /> <br />Regular Meeting <br /> <br />July 13, 1981 <br /> <br />Page 3 <br /> <br />Mr. James introduced fOr consideration approval to pave Bishop Street. <br />Council asked Mr. Jim Byrn what $318,000 worth of Community Develop- <br />ment Funds could~buy in regard to paving'Bishop Street. Mr. Byrn <br />indicated they could level the hill, acquire approximately $90,000 <br />in right-of-way from Franklin to Ranch Road 12, do minor reconstruc- <br />tion work on the street and shoulders and then overlay and do some <br />minor drainage work. Mr. Cavazos moved that the above-mentioned <br />work in the amount of $318,000 be done and Mr. James seconded the <br />motion. At this point Mr. James made a motion to amend this motion <br />to include more right-of-way work be done in place of the money going <br />into overlay for the street. There was no second to his motion. On <br />roll call of Mr. Cavazos' motion, the following vote was recorded: <br /> <br />AYE: Brown, Cavazos, James and Kreczmer. <br /> <br />NAY: Mendez. <br /> <br />ABSTAIN: None. <br /> <br />Mr. James introduced for consideration a Resolution approving an Agree- <br />ment with the Surveyor for right-of-way easement on Bishop Street, the <br />caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF <br />AN AGREEMENT WITH DABNEY-BYRN AND ASSOCIATES FOR SUR- <br />VEYING SERVICES IN CONNECTION WITH THE PROVISION OF A <br />STRIP RIGHT-OF-WAY MAP FOR BISHOP STREET; AUTHORIZING <br />THE CITY MANAGER OF SAID CITY TO EXECUTE SAID AGREEMENT <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. James moved to adopt the Resolution and Mr. Cavazos seconded the <br />motion, which passed unanimously. <br /> <br />Mr. James introduced for consideration the approval of extension of <br />the Victory Gardens Phase III construction contract. Mr. Cavazos <br />moved for the approval of extension of the contract as outlined in <br />the letter of Kelly Kilber of Pro-Tech Engineering Group dated July <br />9, 1981 attached to these minutes and Mr. Brown seconded the motion, <br />which passed unanimously. <br /> <br />Mr. James introduced for consideration an Ordinance on first reading <br />and a public hearing amending Appendix A of the Code of Ordinances en- <br />titled General Zoning Ordinance. Mr. James opened the public hearing. <br />No'one wishedto speak for or against the amendment, so Mr. James closed <br />the public hearing. The Ordinance was read in its entirety, the cap- <br />tion which follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING APPENDIX A OF THE CODE OF <br />ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS, ENTITLED <br />':GENERAL ZONING ORDINANCE" TO INCLUDE "HOME OCCUPATION" <br />AS A SPECIFIC USE ALLOWABLE IN "'R-i' SINGLE-FAMILY <br />DWELLING DISTRICTS," "'TH' TOWNHOUSE RESIDENTIAL DIS- <br />TRICTS,'' "'R-2' DUPLEX OR TWO FAMILY DWELLING DISTRICTS" <br />AND "'D' MULTI-FAMILY DWELLING DISTRICTS" AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />Mr. Kreczmer moved to approve the Ordinance on first reading and Mrs. <br />Mendez seconded the motion. On roll call the following vote was re- <br />corded: <br /> <br />AYE: Cavazos, James, Kreczmer and Mendez. <br /> <br />NAY: None. <br /> <br />ABSTAIN: None. <br /> <br />Mr. Brown was not present to vote on this Ordinance. <br /> <br /> <br />
