115 Regular Meeting July 13, 1981 Page 3 Mr. James introduced fOr consideration approval to pave Bishop Street. Council asked Mr. Jim Byrn what $318,000 worth of Community Develop- ment Funds could~buy in regard to paving'Bishop Street. Mr. Byrn indicated they could level the hill, acquire approximately $90,000 in right-of-way from Franklin to Ranch Road 12, do minor reconstruc- tion work on the street and shoulders and then overlay and do some minor drainage work. Mr. Cavazos moved that the above-mentioned work in the amount of $318,000 be done and Mr. James seconded the motion. At this point Mr. James made a motion to amend this motion to include more right-of-way work be done in place of the money going into overlay for the street. There was no second to his motion. On roll call of Mr. Cavazos' motion, the following vote was recorded: AYE: Brown, Cavazos, James and Kreczmer. NAY: Mendez. ABSTAIN: None. Mr. James introduced for consideration a Resolution approving an Agree- ment with the Surveyor for right-of-way easement on Bishop Street, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN AGREEMENT WITH DABNEY-BYRN AND ASSOCIATES FOR SUR- VEYING SERVICES IN CONNECTION WITH THE PROVISION OF A STRIP RIGHT-OF-WAY MAP FOR BISHOP STREET; AUTHORIZING THE CITY MANAGER OF SAID CITY TO EXECUTE SAID AGREEMENT AND DECLARING AN EFFECTIVE DATE. Mr. James moved to adopt the Resolution and Mr. Cavazos seconded the motion, which passed unanimously. Mr. James introduced for consideration the approval of extension of the Victory Gardens Phase III construction contract. Mr. Cavazos moved for the approval of extension of the contract as outlined in the letter of Kelly Kilber of Pro-Tech Engineering Group dated July 9, 1981 attached to these minutes and Mr. Brown seconded the motion, which passed unanimously. Mr. James introduced for consideration an Ordinance on first reading and a public hearing amending Appendix A of the Code of Ordinances en- titled General Zoning Ordinance. Mr. James opened the public hearing. No'one wishedto speak for or against the amendment, so Mr. James closed the public hearing. The Ordinance was read in its entirety, the cap- tion which follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING APPENDIX A OF THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS, ENTITLED ':GENERAL ZONING ORDINANCE" TO INCLUDE "HOME OCCUPATION" AS A SPECIFIC USE ALLOWABLE IN "'R-i' SINGLE-FAMILY DWELLING DISTRICTS," "'TH' TOWNHOUSE RESIDENTIAL DIS- TRICTS,'' "'R-2' DUPLEX OR TWO FAMILY DWELLING DISTRICTS" AND "'D' MULTI-FAMILY DWELLING DISTRICTS" AND DECLARING AN EFFECTIVE DATE. Mr. Kreczmer moved to approve the Ordinance on first reading and Mrs. Mendez seconded the motion. On roll call the following vote was re- corded: AYE: Cavazos, James, Kreczmer and Mendez. NAY: None. ABSTAIN: None. Mr. Brown was not present to vote on this Ordinance.
