122 <br /> <br />ORDINANCE NO. 19 81-52 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING SECTION 33-9 <br />OF THE CODE OF ORDINANCES, CITY OF SAN MARCOS, <br />TEXAS, TO REQUIRE COMMERCIAL TOWING AND WRECKER <br />SERVICES PARTICIPATING IN THE ROTATING SYSTEM <br />OF NOTIFICATION OPERATED BY THE SAN MARCOS <br />DEPARTMENT OF PUBLIC SAFETY TO MAINTAIN SPECIFIED <br />AMOUNTS AND KINDS OF INSURANCE, TO SET REQUIRE- <br />MENTS FOR INSURANCE POLICIES PROCURED PURSUANT <br />TO SAID SECTION AND DECLARING AN EFFECTIVE DATE. <br /> <br /> WHEREAS, the City Council of the City of San Marcos, Texas, <br />believes there is a need to-require that commercial towing and <br />wrecker services participating in the rotating system of notifica- <br />tion operated by the San Marcos Department of Public Safety main- <br />tain insurance coverage to cover damage to towed vehicles (cargo <br />insurance); now, therefore, <br /> <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br /> SECTION 1. That section 33-9 of the Code of Ordinances, <br />City of San Marcos, Texas, is hereby amended to read as follows: <br /> <br />Sec. 33-9. Insurance <br /> <br />Any commercial towing or wrecker service performing <br />services under the provisions of this chapter shall <br />procure and keep in force and effect and shall keep <br />on file with the City Secretary of the City of San <br />Marcos a policy of public liability and property <br />damage insurance, or a certificate of insurance, <br />issued by a casualty insurance company which is <br />authorized to do business in Texas. Said policy or <br />certificate shall be in the standard form approved <br />by the State Board of Insurance and shall contain <br />a provision that at least ten days prior notice of <br />material change or cancellation of said insurance <br />shall be ~iven to City by the insurance company, <br />and a provision including the City of San Marcos <br />as an additional named insured. The coverage pro- <br />visions of said policy shall insure the public from <br />loss or da~ge that may arise to any person or prop- <br />erty by reason of the operation of a commercial <br />wrecker participating in the rotating system of <br />notification operated by the San Marcos Department <br />of Public Safety and shall be in the minimum amounts <br />of: <br /> <br />For damages arising out of bodily <br />injury to or death of any one person <br />in any one accident <br /> <br />$100,000.00 <br /> <br />For damages arising out of bodily <br />injury to or death of two or more <br />persons in any one accident <br /> <br />300,000.00 <br /> <br />For damage to or destruction of <br />property <br /> <br />100,000.00 <br /> <br />For damage to towed vehicle <br /> (cargo insurance) <br /> <br />1,000.00 <br /> <br />Provided, however, for satisfaction of the requirement <br />for insurance against damage to a towed vehicle, a <br />surety bond in the minimum amount of one thousand <br />dollars ($1,000.00) may be provided to City. Said <br /> <br /> <br />
