RESOLUTION 1981-41R 83 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE SAN MARCOS CITY PERSONNEL POLICIES ADOPTED MARCH 23, 1981, TO DESIGNATE THE PERSONNEL APPEALSBOARDAS THE APPELLATE BODY FOR PERSONNEL~ACTIONS WITH FINAL AUTHORITY OVER THOSE ACTIONS; TO DESIGNATE THE CITY MANAGER AS THE APPOINTING AUTHORITY FOR THE PERSONNEL APPEALS BOARD AND DECLARING AN EFFECTIVE DATE. WHEREAS, the~City Council of the City of San Marcos, Texas, approved and adopted the San Marcos City Personnel Policies on March 23, 1981; and WHEREAS, the Policies, as adopted, designated the City Manager as the person making the final decision in personnel appeals and stated that the Personnel Appeals Board would make recommendations on personnel appeals to the City Manager; and, WHEREAS, the Policies, as adopted, designated the Council as the appointing authority for the Personnel Appeals Board; and, WHEREAS, the City Council, on May 18, 1981, determined that the Personnel Appeals Board would continue to function as it had in the past and that the board would continue to be appointed by the city manager with the consent of the city council; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That section ll. Ol(a)(1)(b) of the San Marcos City Personnel Policies, adopted March 23, 1981, is hereby amended to read as follows: 11.01 The Appeals Process a. The Personnel Appeals Board 1. Repponsibilities shall include: ...b) rendering decisions on appeals made by City employees except Executive Staff and probationary employees on such matters as diciplinary suspension, discharge, demotion, or removal from permanent Sta- tus according to the City's personnel policies. The decisions of the board will be final and no appeals will be entertained. PART 2. That section ll.01(b)(4) of the San Marcos City Personnel Policies, adopted March 23, 1981, is hereby amended to read as follows: 11.01 The Appeals Process b. Personnel Appeals Procedure The Board convenes and delivers a written decision within 10 days of the hearing. The decision of the Personnel Appeals Board is final and is not subject to review by any City official or employee. PART 3. That section ll.01(c) of the San Marcos City Personnel Policies, adopted March 23, 1981, is hereby amended to read as follows:
