RESOLUTION 1981-41R 83 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE SAN MARCOS CITY PERSONNEL <br />POLICIES ADOPTED MARCH 23, 1981, TO DESIGNATE THE <br />PERSONNEL APPEALSBOARDAS THE APPELLATE BODY FOR <br />PERSONNEL~ACTIONS WITH FINAL AUTHORITY OVER THOSE <br />ACTIONS; TO DESIGNATE THE CITY MANAGER AS THE APPOINTING <br />AUTHORITY FOR THE PERSONNEL APPEALS BOARD AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br /> WHEREAS, the~City Council of the City of San Marcos, Texas, approved <br />and adopted the San Marcos City Personnel Policies on March 23, 1981; and <br /> <br /> WHEREAS, the Policies, as adopted, designated the City Manager as the <br />person making the final decision in personnel appeals and stated that the <br />Personnel Appeals Board would make recommendations on personnel appeals <br />to the City Manager; and, <br /> <br /> WHEREAS, the Policies, as adopted, designated the Council as the <br />appointing authority for the Personnel Appeals Board; and, <br /> <br /> WHEREAS, the City Council, on May 18, 1981, determined that the <br />Personnel Appeals Board would continue to function as it had in the past <br />and that the board would continue to be appointed by the city manager with <br />the consent of the city council; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br /> PART 1. That section ll. Ol(a)(1)(b) of the San Marcos City Personnel <br />Policies, adopted March 23, 1981, is hereby amended to read as follows: <br /> <br />11.01 The Appeals Process <br /> <br />a. The Personnel Appeals Board <br /> <br />1. Repponsibilities shall include: <br /> <br />...b) rendering decisions on appeals made by City <br /> employees except Executive Staff and probationary <br /> employees on such matters as diciplinary suspension, <br /> discharge, demotion, or removal from permanent Sta- <br /> tus according to the City's personnel policies. The <br /> decisions of the board will be final and no appeals <br /> will be entertained. <br /> <br /> PART 2. That section ll.01(b)(4) of the San Marcos City Personnel <br />Policies, adopted March 23, 1981, is hereby amended to read as follows: <br /> <br />11.01 The Appeals Process <br /> <br />b. Personnel Appeals Procedure <br /> <br />The Board convenes and delivers a written decision <br />within 10 days of the hearing. The decision of <br />the Personnel Appeals Board is final and is not <br />subject to review by any City official or employee. <br /> <br /> PART 3. That section ll.01(c) of the San Marcos City Personnel <br />Policies, adopted March 23, 1981, is hereby amended to read as follows: <br /> <br /> <br />
