Regular Meeting <br /> <br />January 13, 2003 <br /> <br />132. <br /> <br /> Page 11 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AN AGREEMENT BETWEEN THE CITY AND BYRN AND ASSOCIATES, INC. <br />FOR PROFESSIONAL SERVICES IN CONNECTION WITH THE MCCARTY ROAD <br />INTERCEPTOR PROJECT; AUTHORIZING THE CITY MANAGER TO EXECUTE THIS <br />AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE TERMS AND CONDITIONS OF AMENDMENT NO. 1 TO THE <br />AGREEMENT FOR THE NORTH IH35 WASTEWATER IMPROVEMENTS PROJECT; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT; AND DECLARING <br />AN EFFECTIVE DATE. (adoption, as amended). <br /> <br />Mayor Habingreither introduced for consideration Item 28 removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br />follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING A WAIVER OF CONSTRUCTION PERMIT FEES FOR SAN MARCOS <br />CONSOLIDATED INDEPENDENT SCHOOL DISTRICT FOR A NEW CONCESSION STAND <br />AT THE HIGH SCHOOL BASEBALL FIELD; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Mihalkanin moved for adoption of the Resolution and Mr. Mayhew <br />seconded the motion. Ms. Narvaiz inquired whether this Resolution would <br />set a precedent. Mr. O'Leary stated he does not feel the adoption of this <br />Resolution would tie the City to the future. He stated Dr. Perez may <br />request all fees under $200 to automatically be waived. Staff is working <br />on bringing proposed substantial fees to the Council. Mr. Taylor stated <br />he feels this is a great idea and wants to look at more in the future. The <br />Council then voted unanimously for adoption of the Resolution. <br /> <br />Mayor Habingreither introduced a discussion regarding Recycling Drop-Off <br />Center Request for Proposal. Mr. 0'Leary reviewed some of the changes to <br />the Request for Proposal. He explained some of the changes are regarding <br />the Contractor's age of equipment, noise level for the collection vehicles <br />during the stationary compacting process, and performance bonds. Ms. <br />Narvaiz stated the downtown area requested cardboard pickup. Mr. <br />Mihalkanin agreed the cardboard pickup is an important issue. Mr. O'Leary <br />stated the RFP could include providing cardboard pickup service for <br />downtown businesses and for the details to be worked out with the <br />customers. Tom Wassenich stated Green Guy did provide cardboard services, <br />but it required a large packing truck. Mr. Mihalkanin inquired why Green <br />Guy stopped providing this service. Kyle Hahn, owner of Green Guy, stated <br />he contracted with a vendor due to high insurance costs, decreasing cost <br />of cardboard and additional time and fees for cleaning up contamination on <br />the cardboard. Mr. Mihalkanin asked Staff to see whether adding the <br />cardboard service to the contract would be feasible. Mr. Hahn stated he <br />processes cardboard now for haulers, and the drop-off center could <br />subcontract with haulers to provide this service. Mr. Mihalkanin stated <br />he feels the wording on page 8 c. Proposal Bond is too vague. He inquired <br />whether this is a five-year bond or five annual bonds. Mr. Mark Taylor <br /> <br /> <br />
