On roll call for adoption of the Zoning Ordinance, the following vote was recorded: AYE: Habingreither and Taylor. NAY: Mihalkanin, Montoya, Narvaiz, Mayhew and Tatum. ABSTAIN: None. This Zoning failed. Mayor Habingreither introduced for consideration a public hearing and approval of an Ordinance on first reading, the caption which read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE ABANDONMENT OF A PORTION OF THE ALLEYWAY BETWEEN THE 1200 BLOCKS OF IviARLTON STREET AND EARLE STREET; APPROVING THE CONVEYANCE OF THIS PORTION OF THE ALLEYWAY TO ALBADALANA DANIEL AND NAWONA CRENWELGE; AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED; AND DECLARING AN EFFECTIVE DATE. Mayor Habingreither opened the public hearing and asked if anyone wished to speak. No one did, so Mayor Habingreither closed the public hearing. Mr. Mayhew moved for approval of the Ordinance on first reading and Ms. Tatum seconded the motion, which passed unanimously. Mayor Habingreither introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 2.069 OF THE CITY CODE TO REVISE CITY BOARD AND CONMISSION MEETING ATTENDANCE REQUIREMENTS; AND INCLUDING PROCEDURAL PROVISIONS. Ms. Tatum moved for approval of the Ordinance on first reading and Ms. Narvaiz seconded the motion. Mr. 0'Leary stated the Planning and Zoning Commission asked for these proposed changes to amend the definition of an excused absence to include child care for a newly born or adopted child during the first 8 weeks of a child's life and to clarify that the Chair will be responsible for the determination of whether or not an excused absence has occurred. The Council then voted unanimously for approval of the Ordinance on first reading. Mayor Habingreither introduced for consideration reconsideration of a Zoning Ordinance. The Council did not wish to reconsider this Ordinance. The caption reads as follows:
