Staff does recommend the following optional changes to the <br />ordinance: 1) clarify the definition of non-consent tow; 2) clarify the definition of police <br />authorized tow; 3) change the wording requirement regarding fees on tow-away signs; 4) <br />clarify when a wrecker driver may decline to accept a check or credit card at the scene of <br />a tow; 5) update the requirement for wreckers to carry fire extinguishers with valid and <br />current inspection certificates; and 6) clarify the authority of the Chief of Police to <br />suspend from the rotation system any wrecker service that overcharges for an accident <br />tow. Chief Williams also presented optional minimum requirements for non-consent <br />tows: 1) require a special permit for non-consent tows (including non-consent tows) with <br />provisions for revocation for repeated violations; 2) require a property owner or manager <br />to summon a wrecker to remove a vehicle before the vehicle can be removed; 3) set a <br />maximum wrecker fee of $0 for the owner or operator of the vehicle if a wrecker removes <br />a vehicle without having been summoned by a property owner or manager; 4) suspend <br />from the rotation system any wrecker service that violates the non-consent tow <br />provisions; and 5) require additional warning signs be posted before vehicles can be <br />removed. <br />Council consensus was to require a property owner or manager to summon a wrecker to <br />remove a vehicle before the vehicle can be removed; to approve the proposed fees; to <br />include all forms of acceptable payment with an additional charge for credit card use <br />(staff will confirm the legality of the additional charge); add a local storage requirement; <br />additional language regarding storage fees on the signs; to allow suspension from the • <br />rotation system for violations; and to provide adequate latitude for revocation. <br />25.
