• 22. Consider adoption of Ordinance 2008-29, ordering a General and Special <br />Election to be held on November 4, 2008 for the purpose of electing a Mayor, City <br />Council Member, Place 3, a City Council Member, Place 4; submitting proposed <br />amendments to the City Charter and a non-binding referendum on extending the <br />hours for the sale of mixed alcoholic beverages to 2:00 A.M. to the voters; <br />establishing early voting locations and polling places for this election; making <br />provisions for conducting the election; and declaring an emergency. <br />MOTION: Upon a motion made by Councilmember Couch and a second by <br />Councilmember Guerrero, and amended to reflect a correction to the non-binding <br />referendum language, the City Council voted seven (7) for and none (0) opposed, to <br />approve Ordinance 2008-29, as amended. The motion carried unanimously. <br />The language for the non-binding referendum was amended to read, "for the sale of <br />alcoholic beverages for on-premises consumption to 2:00 a.m." <br />23. Consider adoption of Resolution 2008-117R, awarding a construction contract to <br />Rodman, LLC for the FM 3407 (Wonder World Drive) Extension Project from RM <br />12 to Stagecoach Drive in the amount of $26,218,770.89 contingent upon the City's <br />receipt of approval for project award from the Texas Department of <br />Transportation; authorizing the City Manager to execute the contract documents on <br />behalf of the City and declaring an effective date. <br />• MOTION: Upon a motion made by Councilmember Thomaides and a second by <br />Councilmember Guerrero, the City Council voted seven (7) for and none (0) opposed, to <br />approve Resolution 2008-117R, as previously captioned. The motion carried <br />unanimously. <br />Council agreed to set aside $4 million as a contingency to cover possible change orders. <br />Council agreed to the following options to save existing trees: <br />1) 705 trees @ $100/tree; <br />2) Structural mitigation for 101 trees @ $4,600/tree for trees (8" - 18" caliper) <br />within the clear zone or cut-n-fill sections. <br />24. Discussion on licensing and regulating wrecker services, procedures for non- <br />consent tows on private property, fees for wrecker services, and the procedure for <br />wrecker companies to gain a place on the police rotation system and give direction <br />to staff. <br />Police Chief Howard Williams provided a presentation regarding suggested revisions to <br />the City of San Marcos Wrecker Ordinance. The ordinance established the fees for <br />- wrecker services, but they have not been revised since 2002.
