149

Regular Meeting

August 10, 1981

Page 3

the public hearing. The Ordinance was then r~ead in its entirety, the
caption which follows:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
MARCOS, TEXAS, ~4ENDING SECTION 3 OF THAT ORDINANCE
WHICH REGULATES AND RESTRICTS THE LOCATION AND USE
OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER
29, 1980 (VOL. 54) BY CHANGING THE ZONING OF 1.706
ACRES OF LAND OUT OF THE J. M. VERAMENDI LEAGUE NO.
ONE, LOCATED OFF HUNTER ROAD ABOUT ONE AND ONE-HALF
MILES SOUTHWESTERLY FROM THE HAYS COUNTY COURTHOUSE,
FROM "AO" (AGRICULTURAL OPEN-SPACE DISTRICT) TO "MH"
(MOBILE HOME DISTRICT).

Mrs. Norris moved that the Ordinance be approved on first reading and
Mr. Kreczmer seconded this motion to get the matter on the table for
discussion. Mr. Joe Garza then enumerated Staff's concerns to the
zoning request. This particular area is serviced only by one private
road; there is a lack of control and lack of right-of-way in this area.
It would take a considerable amount of time and cost to correct these
problems. Mr. Brown asked Mr. Garza what the future development of
this area might be. Mr. Garza indicated the Planning Department had
no clear definition for the area's future land use. The area is in
the flood plains and in a proposal, has been designated as a location
for a flood retention dam. The zoning request contains only 1.706
acres of land, and Staff pointed out to the Planning and Zoning Com-
mission that the property was less than the area requirement for a
mobile home district (3 acres). Before Planning and Zoning would
take any action on the zoning request, the property developer obtained
a variance from the Board of Appeals and Adjustments. The variance
was granted because the property was contiguous to a larger mobile
home park. Because of the Staff concerns, Mr. Cavazos moved that
the Ordinance be tabled and Mr. Brown seconded the motion, which
passed unanimously. If the request comes before the Council again
in the future, it would need to have public notice of a 'public hear-
ing again.

Mayor Craddock introduced for consideration a public hearing on a
Zoning Ordinance on 66.71 acres of land located on Post Road from
"AO" (Agricultural Open-Space District) to "I" (Industrial District,
known as the Barker-Warren property. Mayor Craddock opened the
public hearing. Ron Carroll, representing the owners of the property
made a presentation to the Council on the future development of the
property. No one else wished to speak in favor of the zoning request
and no one opposed the request, so Mayor Craddock closed the public
hearing. Mrs. Norris moved that the zoning request be tabled until
such time we had proper field notes and information to make a deci-
sion and Mrs. Mendez seconded the motion. On roll call the following
vote was recorded:

AYE: Craddock, Kreczmer, Mendez and Norris.

NAY: Cavazos and James.

ABSTAIN: Brown.

Mayor Craddock introduced for consideration a Zoning request on se-
cond reading, the caption which was read as follows:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE
WHICH REGULATES AND RESTRICTS THE LOCATION AND USE
OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER
29, 1980 (VOL. 54) BY CHANGING THE ZONING OF 6.178
ACRES IN THE J. M. VERAMENDI LEAGUE NO. TWO, ABSTRACT
17, LOCATED ON RIVER ROAD, FROM "AO" (AGRICULTURAL
OPEN-SPACE DISTRICT) TO "MH" (MOBILE HOME DISTRICT).
