1.2.2 Secure title commitment updates in accordance with insurance rules and requirements for <br />parcel payment submissions. The City will provide preliminary title commitments to the <br />Consultant. The City will pay for any preliminary title commitments. <br />1.2.3 Secure title insurance for all parcels acquired, insuring acceptable title to the City and <br />ensure that written approval is provided by the C ity for any exception. The City will pay the cost <br />of the title insurance. <br />1.3 TASK 3 —RIGHT OF ENTRY AGREEMENTS <br />The Consultant will: <br />1.3.1 Upon request from the City, secure written rights of entry from designated real property <br />owners for the purpose of gaining access for surveying, appraising, field inspection of right -of- <br />way alignments and other purposes as may be determined. <br />1.4 TASK 4— INITIAL APPRAISAL SERVICES <br />The Consultant will: <br />1.4.1 Upon request from the City, prepare and conduct personal pre- appraisal contacts with <br />real property owners and /or the designated real property representative(s) for each parcel. The <br />City will engage the fee appraiser and coordinate with the appraiser regarding revisions, <br />comments or additional information that may be required by the City. The City will review the <br />appraisal reports to determine consistency of values, supporting documentation related to the <br />conclusion reached and compliance with the Un iform Standards of Professional Appraisal <br />Practices. <br />1.4.2 If requested by the City, contact real property owners or their designated representative(s) <br />to offer them the opportunity to accompany the appraiser on the appraiser's inspection of the <br />subject real property. In addition, the Consultant will maintain record(s) of each such contact in <br />parcel file for the Project. <br />1.5 TASK 5— NEGOTIATION SERVICES <br />The Consultant will: <br />1.5.1 Contact and negotiate with each real property owner in an attempt to acquire the <br />necessary easement. On the first contact, the Consultant will provide real property owners with <br />the Texas Landowner's Bill of Rights. The Consultant will initially ask the real property owners <br />for a donation of the proposed easement. At the City's discretion, the Consultant will tender a <br />compensation amount to the real property owner for settlement. The Consultant will utilize <br />forms and documents prescribed by the City in negotiations with all real property owners. In <br />coordination with the City, the Consultant will prepare the initial offer letter, a memorandum of <br />agreement, instruments of conveyance and any other documents required or requested by the <br />City for the City's review and approval. The Consultant will make at least three attempts, in a <br />LAN - Comanche 24 In Agreement <br />
