if appropriate, are properly served with the Petition and Notice of Hearing. <br />j) File all original documents with the court and send copies marked "copy" to the City <br />and the City's legal counsel. <br />k) Send a copy of the petition to the title company so that the title company can ensure <br />that the appropriate parties were joined and that no changes in title have occurred. <br />1) Set the Commissioners Hearing after the updated appraisal has been submitted, if <br />there is no change in value. If there is an increase in value, the City will make a <br />revised offer and a final offer letter and s ubmit a copy to the real property owner. <br />m) Send a written notice of the Commissioners Hearing to the City's legal counsel so <br />that a conference room or courtroom may be reserved for the hearing. <br />n) Coordinate the hearing date with the City's legal counsel, the initial fee appraiser, <br />City's representative, three commissioners, and a court reporter. <br />o) Coordinate a pre- hearing conference prior to the hearing (the day before or earlier) to <br />discuss facts of the case with the City's legal counsel, the appraiser, and the City. <br />p) After the hearing is set, serve Notices of Hearing to the indicated parties at least 11 <br />calendar days prior to the commissioner's hearing. <br />q) Once the notices have been served, file the original notices with the court and send <br />copies stamped "copy" to the City and City's legal counsel. <br />r) Send a reminder letter 14 -21 calendar days in advance to the City's legal counsel, the <br />appraiser, three commissioners, court reporter, and the City concerning hearing dates. <br />1.7.2 Provide post hearing support <br />a) For the hearing, prepare Form RTE 73, "Data Sheet — Commissioner's Hearing" or <br />equivalent as applicable along with commissioner's time sheets. Submit Form RTE - <br />73 or equivalent as applicable, to the City. <br />b) Obtain the signatures of commissioners on the Award of Commissioners and file with <br />the court for the judge's signature within 48 hours of the hearing. <br />c) Provide commissioner's timesheets to the judge. The judge will determine the amount <br />to be paid to the commissioners by the City. <br />d) Obtain and distribute three certified copies of the award as follows: one certified copy <br />to the title company with a request for a commitment, one certified copy to the City's <br />legal counsel, one certified copy to the City with the Commitment to request the <br />check in the amount of the commissioners' award. <br />e) Send the commitment and the award to the City, along with individual <br />commissioner's billing statements Form 132 or equivalent as applicable, requesting <br />the payment of fees. <br />f) File the City check in the registry of the court. File a Notice of Deposit with the court <br />and send one certified copy to each defendant notifying them of the date of the <br />deposit. Record that the date of deposit is the date of take. <br />g) Take photograph of the real property interest to be acquired on the date of deposit for <br />relocation verification. <br />h) Send written notices of the date of deposit to the City and all interested parties. <br />i) Appear as an expert witness as requested.
