The Consultant will: <br />1.6.1 Coordinate with the City and title company to obtain an updated title commitment along <br />with other forms and a certified copy of the instrument of conveyance necessary when requesting <br />the parcel payment from the City. <br />1.6.2 Attend closings and provide closing services in conjunction with the title company. <br />1.6.3 Ensure that the title company records all original instruments immediately after closing in <br />the respective County Clerk's Office including donation agreements. The Consultant will <br />deliver an executed easement document to the Ci ty if not being provided by the title company. <br />1.7 TASK 7— CONDEMNATION SERVICES <br />The Consultant will: <br />1.7.1 Provide pre- hearing support: <br />a) Upon receipt of a copy of the final offer, request an updated title commitment for <br />eminent domain from a City approved Title Company. <br />b) Prepare a bisection clause for the original set of legal descriptions supplied by the <br />City. (When applicable) <br />c) Use the information from the title commitme nt to join all interested parties on the <br />form RTE -49 "Request for Eminent Domain Proceedings" or equivalent as <br />applicable. Spouses of owners must be joined. <br />d) Upon completion of the form RTE49, prepare a packet containing two (2 ) copies each <br />of the following documents: RTE49 form, commitment, negotiator's reports, <br />appraisal acknowledgment, pre - appraisal contact sheet, signed and sealed property <br />description, plat, final offer letter, any correspondence from the real property owner <br />or its representative and one copy of the appraisal report. Submit this packet to the <br />City for review by the City's legal counsel. <br />e) Upon receipt of concurrence for the appraisal witness, request the update of the <br />appraisal. <br />f) The City's legal counsel will prepare and return to the Consultant a packet that <br />includes: Petition for Condemnation, Lis Pendens, Order Appointing Commissioners, <br />Order Setting Hearing, Oath of Special Commissioner, and Notice of Hearings. The <br />Consultant will file the original petition with the appropriate County Court at Law or <br />other appropriate Court for a cause number to be assigned. <br />g) File the Lis Pendens including the cause number with the appropriate County Clerk's <br />Office. <br />h) Upon assignment of a court, file the Order Appointing Commissioners with the judge <br />and retain a copy of the order for the City's files. <br />i) Following appointment of Commissioners, secure the following documents: Oath of <br />Commissioners signed by the Commissioners, Order Setting Hearing, two copies of <br />the Notice of Hearing signed by the Commissioners and ensure that copies of these <br />documents are maintained in the City's files.
